That would be the reason I suggested it.  I already said that without that assistance, your chances of getting the two expedites you need to make a difference would be very slim.  Under humanitarian circumstances a visit visa can actually be approved and expedited with political assistance.

Actually, Boiler is correct. The senator cannot make your case strong. Your case is going to have to stand on its own merits. The senator cannot force an Executive Branch agency to do anything, but the senator will have contacts within that agency - through a congressional liaison, to whom the senator may present your case in a more complete and expeditious manner. 

You will also need documents proving your mother-in-law's condition, to go along with your request.

i got it. were going to call their congresswomans office. and were all set with thye evidence. doctors letter, colonoscopy result etc. were just doing extreme hardship letter showing the effects of it to the petitioner. financially. physically emotionally and psychologically. what do u think? good enough?

As I mentioned you need to focus more on your relationship with MiL, that is the reason you are seeking an expedite.

Yes, and rather than the "congresswoman", I suggest contacting the office of the Senior Senator from your husband's state.  If that office is too far away, then the more local congresswoman might be a good second choice.

Boiler is pointing you in the right direction to take. 

If you care to go the other way, and base your request on financial hardship and emotional/psychological issues with your husband, you are going to need to prove that he is not able to work at all...the the point that his job is in jeopardy. You'd have to prove that there are no other caretakers available and that she needs his constant care. To prove psychological issues with your husband, as a result of this, you will need medical records for him which state this.

I will offer that I suffer from complex PTSD, and my son is autistic. I have no family of my own. All these things are very well documented. Both USCIS and the State Department denied my request to expedite my husband's visa petition.

Either choice will have the same result. Either will result in what the Executive Branch agencies refer to as a "Congressional Inquiry." Whether you choose the Congressional Representative or the Senator, it matters not. Neither swings a bigger bat than the other. All either can do is expeditiously present the request and supporting documents to their liaison at Homeland Security. 

Again, many people are under the misconception that a Congressional Representative or Senator can somehow make a Federal Agency do something they normally would not do on their own. That is not how it works. Now, if you had happened to have already requested an expedite, and USCIS did not follow their own guidelines for approval of such, and instead denied you in error...that's where congressional help may have the biggest benefit.

The more senior the politician, the more experienced their staff will be.  What they can do for you is to get the immediate attention of decision makers.  They cannot be expected to persuade the decision maker to make an incorrect decision.

 

Additionally, I'm suggesting you ask not just to expedite the immigrant visa case but to have a visa issued for the short term to remedy the problem.  This would mean it would be YOU taking care of your mother in law, so that your husband could work.  If this is going to be a long term health issue, of more than a few months, a short term visit will not help, so that's not going to work.  For the long term, you need the immigrant case expedited through both USCIS and NVC, onward to the Consular Immigrant Visa Unit in your country.

I would suggest that your husband have all the documents ready to be sent, and the two of you decide which reason for the request to expedite you are going to pursue. He can call USCIS and request it over the phone, but he will need to submit the supporting documents. You will get a response from USCIS in a matter of a few days. If they deny the request, then you could turn to your congressional representative or Senator. The Senator or Rep will ask if you have been denied already, anyway. 

But, again, don't look for the Senator or Rep to have a magic wand that can force USCIS to approve something that may not meet USCIS criteria for an expedite.

Legally, the only option available by next week for the grandma to see the usc grandchild, and assuming the grandchild has a passport is for the dad tofly back to bring the baby to the us. He would probably need a letter of permission from the mom. I suppose another trusted person could do so with letters of parental consent from both people.

 

There are some practical things wrong with this (who will care for baby if dad is busy with Grandma?) but this is the fastest option.
