hi everybody

i m in huge dilema. my wife visit back country after one year residency in USA. unfortunetly she cant get back USA on her time period and its been 4 yeras now. she got two baby on abroad too. we file DS117 returning status but the consular denied it stated various reason. he suggests us go back USA and reapply I130 again like as initial procedure. 

so what i to do my wife valid green card and how to re apply again? please help me who has better idea and those who are in same boat .

the GC is for living in the US, she abandoned her residency by living out of the country for so many years

 

you have to start over from scratch, but since she has a GC and a social security number probably, the numbers are given for life

 

so anywhere where they request those numbers you have to put them

because you didn't put the number on the forms, they shouldn't have given her a new number

 

the numbers are given for life.

 

I had a GC when I was a child, I returned to my country and lost residency. later on in life my mom filed for me and I got a new GC, but with the same number as over 30 years later. but you have to put the number where it says if you had a GC, and you should have corrected it or let them know because it was wrong on their part, I got the same number as the one I had as a child

If she hasn't already, she needs to surrender her current GC before you apply for a new immigrant visa. She can do so by sending it/delivering it to the embassy in her country with a letter acknowledging that she is surrendering her claim to permanent residency.

 

If it isn't difficult, it isn't worth it.
