I learn so much here.  I thank you all.  This thread got me thinking...My fiancee has two teenage children who I am bringing with her.  She was married and has been annulled.  The biological father has only seen his kids for 1 month every two years.  He lives as an OFW in Ireland.  Does he need to give them permission to go with her?

Depends (odds are - no).   Do the annulment documents grant her custody of the children?   Age of the child can be a factor also.

"Declaration of nullity or annulment of marriage as decreed by a court or by a church: Provided, that he/she is entrusted with the custody of the children"

And read this.

The kids are 17 and 14.  There was no custody determination in the annulment.  He was a deadbeat dad and he had the psychological incapacity against him.  She went through all the tests and passed them all back then.  Her ex was never part of their lives and paid no support.  He heard she is planning on leaving and he is threatening her with not allowing the kids to leave.

If you read the links I posted you should notice that children over age 7 have the choice of parents ... ( ;) )

I think his threats are hollow.

I do know of a fair number with annulments that have gotten visas without a letter from the father.

Philippines law is heavily tilted towards the mother having sole custody if you do some reading, even in an annulment if the father is not specifically granted custody.. he normally has NO custody.   He can be made to pay child support, but still no custody .. so I have read many times.
