I just noticed that I have yet to read any posts about people actually failing their interview, AOS process. Does this happen or are there a ton of appeals that make it virtually impossible?

You usually don't "fail" your interview outright. They won't approve you right away, and then you get scheduled for another interview -- often a year later!! The second interview might be more in depth and some are given the Stokes interview which is when they separate the couple and ask the same list of questions and then compare your responses. Then it drags on some more and I suppose eventually some get denied. By that time most people have lawyered up and are not hanging around on the forums anymore.

I have also heard of some cases where they take the USC spouse aside and try to pressure them into signing a statement that the marriage is a fraud, and with that they can deny the case much more quickly.

You can also "fail" on a technicality like an affidavit of support that is considered insufficient. In that case you are usually given 60-90 days to come up with whatever they RFE you for. (They will literally hand you an RFE notice at the interview.) The RFE cases usually work out OK as long as you get them the requested evidence within the time limit -- but you may not hear back from them for a long time.

Well I would guess that people who actually take the time to come and post on VJ are real couples who are really in love and have a real relationship. The people who get denied that pay someone $10,000 to marry them so they can get a greencard probably dont come to VJ and post. ;)

Yes people are denied for many diffrent reasons some are told at interview that they are dinied other get a denial in the mail afterwards.... some get a denial in the mail for not returning requested info or failing to show for an interview....

So yes it does happen....

Jeez, that's a scary thought. So, though, from what I get from you is that it's pretty damned hard to fail, with a good lawyer of course. I can't believe they would try to make you sign a self-admittance contract....

There have been tons of people who post about denials. I can recall a few Jamaican ganga related and just recently.

It happens all the time for one reason or another.

Life's just a crazy ride on a run away train

Its actually very easy to be denied..... all you need to do is any of the following:- Leave the US without an AP, Remain outside the US for longer than allowed, Fail to respond to a RFE by the date given, fail to turn up for your Biometrics appointment, Give false info on your Forms, Fail to turn up for your AOS interview (even if you get a e-mail telling you its been cancelled), fail to apply for removal of conditions on time, and these are just a few reasons...

There are numerous cases of AOS Interview resulting in a Denial,

Anything can happen, mostly due to improper information presented or Applicants not following procedeures correctly such as failing to submit inof requested for RFE's or othe rforms,

Missing critical time sensitive Appt.s ( Biometrics, medical ect..)

Violating and conditions relating to thier current Visa/ Immigration status.

If USCIS suspects applicant has intnetions other thna that of bona fida AOS due to Marriage then that would result in denial.

keep in mind the Interview process is to Screen those who USCIS find are not legitmate in their pursuit of AOS GC.

Their inital objective is to look for reason Not to Approve.

Idiot or not, You can get denied if you have descrepancies like others have posted. And dont forget to have with you an enterpretor if your spouse cannot speak English very well. This is prob the most important interview so be ready with everything in order that they ask for.

It is Not a matter of ones intelligence. It could be the USCIS decides to scrutinize a specific case as a random check or because something looks like it is not right.

To answer your question ridejewel..

As this is a Govt. process extra time, and care should be taken to be sure that everything is submitted EXACTLY as asked.

All intructions of all forms should be read & understood, everything submitted should be submited in the format requested, with proper support documentation as requested in addition to this if USCIS makes a msitake and asks for RFE or resubmission then Applicant should be on top ofthings and in a timely manner repsond to any and all correspondaces with due diligence.

You have to check & re-check everything, make copies of everything sumbitted and Make sure everything is Organised.

It has to be easy for USCIS to go through Application and find what they need to make thier descision.

Prior to the interview Applicants MUST be prepared to answer any and all possible questions, with genuine responses. not giving mor einfo than asked but NEVER withholding information requested of them.

So sometimes people are denied because of a language barrier and misunderstanding of questions asked.

be prepared you should be fine as long as your case is legit.

I am not going to get in details, just because this is a public forum, but I know one person that had their application ALMOST denied.

To make a VERY long story short, this guy (immigrant) is friends with my wife and after he got married they applied for AOS and right after the interview the wife (USC) got transferred with her job to a different state... at the interview they were missing W2's, so the officer asked them to mail it in and said that it would be approved as soon as they mail the missing evidence in. They did mail it, the wife moved and the husband decided to stay for a few more weeks until everything got approved (they didn't want to change address because it was only a matter of a couple weeks..) so finally 4 months later and after several infopass appts, the guy went for yet another infopass appt and after almost 30 minutes of "arguing" with the officers in there, who thought it was unusual that the wife lived in a different state, they finally told him that they would require a second interview.

A few weeks later, the wife flew in and they had their interview which lasted almost 2 hours... they separated them and asked all kinds of questions, even how many times they had had sex the day before (I SWEAR !!!!!)... and believe or not, they never called the wife (USC) to match up his answers. After 2 hours of extensive questioning they were approved and he got his green card 2 weeks ago in the mail. Happy ending but quite a process....

I too have been looking for that answer. I have not found anything here on VJ or another forum. Does any one else actually have knowledge of that happening AFTER the interview. Obviously there are various reasons why a person can be denied, but does anyone actually know of someone it has happened to after the interview? I have searched with no luck.
