DS-160 from K1 application does mention his job as working as a carer for Carers service which is more a BENEFIT than a job but still taxable income. He made 240 pounds a month. And it's through the UK government.

 

Also I remember asking tax specialist is there anything special we need to do since he's in AOS pending status waiting on a green card. She said no we just list him as a Resident. She said I can't list him as anything else. She then asked him if he had made any income while in the US and we said no. She never mentioned or asked if he made any income while still in UK in early 2014.

Right. We've established that this tax specialist had no idea how to handle this situation and you should request a refund of any money you paid her because she steered you wrong. What resulted is a mistake. And one that it sounds like you are interested in fixing. Especially because you know that the US government is aware of the fact that he had income in that year, but your tax return from that year says otherwise so you know it's possible that they'd notice. I still do not think that even if they noticed that you'd have trouble, but why risk it (especially seeing as how your anxiety is through the roof over this).

 

Fixing this mistake will not negatively effect his citizenship process. Fixing this mistake will cost an estimated $150 (if that). You have instructions on how to fix this mistake. If you find it too difficult to do yourself, take the instructions to a *different tax professional who has experience with immigrants and foreign income* and have them do it.

 Will USCIS notice when looking at our tax transcripts for ROC? I don't know if they review the K-1 paperwork or not. I asked our immigration attorney if when we amend the tax if we should send it into USCIS as an added addition to the ROC packet that we already sent months ago. He said it wasn't necessary but to supply it during the citizenship process.

You are asking the same questions over and over...and over.

You don't need to send it in, if you like you can bring it to a potential interview.

I really have no way of knowing, I haven't done ROC. But if they have the transcript because you sent it as part of your ROC packet and they have the DS-160 (because the K1 paperwork is in their possession), then sure, they could notice. They are trained to look for details and dependencies. I have literally no idea if they look at the K1 paperwork in ROC and somewhat doubt that they look for this kind of discrepancy and I have said several times that I don't even think that a mistake of this (small) magnitude causes any trouble, but to be safe, just amend the return and call it a day. Bring a copy with you in case they ask about it. Then your answer is "oh, yes, we realized the mistake and amended that return after we sent in these papers, here you go". I really don't understand this level of freakout for a very small problem with a very easy solution.

 Maybe I should send the amended return in once it's done I don't want us to get denied ROC because the taxes don't line up with DS-160.

You are not being logical. I don't understand why you are worrying about this. Why on earth would you get denied due to this? Are you trolling??

 

Also, you can't add documents to your file without an rfe, which is why we said to bring it to an interview in case it is brought up there. If it is not then you don't need to worry about it.

USCIS and the IRS do not have a hotline to each other.  USCIS (in the early stages) just cares if the sponsor makes enough money.  In the ROC stages, you would be in trouble ONLY IF THE IRS HAD GOTTEN YOU IN TROUBLE!  If you are not in trouble with the IRS, you will NOT be in trouble with USCIS.  You are doing the right thing by amending your tax return.  I can almost guaran-damn-tee you that you will NOT have any issues if you amend your taxes.

 

Please quit obsessing over your ROC.  You obviously have a bona fide marriage.  So amend your taxes and then live your life.

For the tenth and final time, because at this point I think that you're trolling, hiding something else or incapable of logical thought: no one thinks your ROC will be denied over this no matter what you do. So calm down and read or listen to the advice you actually paid for and stop spinning yourself up. 

 

But look: if you are worried about denial over this issue, waiting to amend is the wrong decision. The DS-160 shows income, your current tax return doesn't. I still don't think this is a denial scenario (ok, eleventh and final time) but it should be fixed and if on the off chance they notice and DO care, then you're better off being able to say that you have already fixed the issue. See?

Ok, well let me ask you this; why are you asking us if you aren't accepting our answers? I even took the time to calculate your approximate tax differences for you, thinking you needed to see black on white that it would be a insignificant amount to feel better about it. You have gotten the same responses from several people and you still repeat your inquiry. I don't have any more answers for you. I wish you the best moving on in what I expect will be a smooth journey.

This is a mistake not evasion. Which we've all said approximately 100 times.  You have everyone here and your lawyer, all of whom know the details telling you how to proceed, and are letting an offhand comment from your sister freak you out? And you think this "certain amount" is $3k? And you think that this could result in jail and or immigration issues even though everyone here and your immigration lawyer have told you differently? The best way to avoid your jail and immigration issues is to ignore every piece of advice given to you and instead of fixing this mistake, let it sit there and see if they catch it? You do realize that most people caught in tax evasion claim it's a mistake when they're caught? And that no one planning tax evasion amends a return to take it back? Who would you prefer to look like? 

 

I'm done. I simply can't believe that you're for real. Go find a tax  professional, a tax attorney even,  and argue with them about "but my sister said"  while they're on the clock.
