Hi there! I'm a US citizen who has been with my husband for a few years, married for only six months. I've been living in Poland for almost a year and a half now, and my husband and I decided that we want to potentially move to the States in two years.

 

Biggest problems: income. :(

 

I'm under the impression that because I'm pretty broke by US standards (making about $1,200 a month is great in Poland, not so great in the States) and because I will have to find a new company/job to work for when I return to the States, this is going to be held against me as a lot of the paperwork talks about having a job that will transfer to the States company-wise. It also talks about owning property in the States (uh, I can't even afford property in Poland!), which we... definitely don't.

 

My husband is about to graduate from uni with his MA in economics, so I'm sure he'll be getting a good job, but they tend to only look at the US citizen's income, yes? Also, I did NOT work all last year because my residency card took THAT long to come through (thanks Poland) and I was basically surviving off my savings the entire time. So, I won't have any taxes to report until next year anyway, as I finally got added to formal payroll for my job in February this year.

 

Basically, are we ineligible because my job situation is far less than ideal or is this all solved by having a joint sponsor whose income is well above the poverty line?

Yes. You will need a joint sponsor. You will need to come back to the US on your own and file your CR1 paperwork. Your husband can visit you if he's able but can't live or work here until the process is complete (about 9-12months). Once he arrived he can start working from day 1.

No.  You will have to move ahead.  He may visit with vwp or a visitors visa or you may visit him.

You can move at the same time provided you can prove at interivew your intent to reestablish domicile and have a qualified joint sponsor.

It would be seriously awful if we couldn't move at the same time. I don't exactly have a degree in a very high in demand field, and HE does. (He's in business/economics, I'm a philosopher.) So, counting on my income here is probably not good unless I magically get offered a job at a college.

Your income from Poland will not count.  Only income that would continue after you move back to the US counts.  Since your Poland income would stop when you move back, it can not be counted for the I-864.

 

A qualified Joint Sponsor will solve your problem.  A JS would allow you and your husband to move together.

Only countries with a USCIS office in their embassies have direct consular filing.  https://www.uscis.gov/about-us/find-uscis-office/international-immigration-offices

Poland is not on this list. 

 

You will need to send the I-130 to the Chicago lockbox.  You will be doing the normal IR1/CR1 route.

You can live in Poland for as long as when the process is complete, but you will need a joint sponsor and enough proof of domicile in the United States (possibly a job offer, a place to stay, maintained driver's licence, bank accounts etc...anything that shows the clear intent of returning to the States as soon as the visa comes through which you can expect about a year from now I think. Unless Warsaw has EP - email processing. That takes people through NVC pretty quick. But USCIS still takes a lot of time)

08 September 2016 - I-130 sent to USCIS Chicago Lockbox (FILED FROM ABROAD)

14 September - I-130 received at Nebraska Service Center

16 September - NOA1 via e-mail

29 September - notice returned to USCIS because the Post Office could not deliver it

22 November - NOA1 finally received in the mail (in the US)

31 March 2017 - NOA 2 via e-mail, app and USCIS website

3 April - NOA 2 received in the mail (in the US)

11 April - Case Was Sent to Department of State 

 

NVC Phase

17 April - Case received by NVC

20 April - NVC case number assigned

21 April -  DS-261 Completed Online
25 April - Welcome e-mail received, AOS fee paid
27 April - IV fee Invoiced, IV fee paid
6 May - DS-260 Completed
10 May - AOS and IV package sent

15 May - Scan date

12 July - Case complete 😀
14 July - P4 Interview Letter

08 August - Medical

17 August - INTERVIEW - approved!
18 August - VISA ISSUED
23 August - Picked up the PASSPORT with the VISA inside

26 August - Immigrant Fee paid
18 September, 2017 - POE 

Removal Of Conditions


25 June, 2019 - ROC packet sent
