REF for Circumstances of meeting and IMB (Bharatmatrimony.com)

Hello I received a RFE for my fiance visa petition on 20th Apr 2017. Below are the details

Circumstances of meeting

Submit information regarding the circumstances under which you and beneficiary met to establish the relationship. This information should include details about how you and the beneficiary initially met as well as information regarding your last personal meeting


if you met the beneficiary though a website or any other business that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between United States citizens and foreign nationals then you are considered to have met the beneficiary through the services of an international marriage broker, As such, you must submit a copy of the signed written consent form that the international marriage broker obtained from the beneficiary, authorizing the release of her personal contact information to you, or submit documentation to establish that the website is not an international Marriage broker.

Dear forum members

I  checked the  no box (Did you meet your fiancé(e) or spouse through the services of an international marriage broker?) for  information  in the I-129F if i had used IMB to meet my fiance, but still received above RFE today. I was not aware that matrimonial website would fall under IMBRA.

 

I am USC of Indian Origin , I met my finance on website called www.bharatmatrimony.com, which provides platform to register and look for  a suitable partner to get date and/or to get married. Membership is free and is available to any one who wants to register and look for partner. However paid membership is required to contact other members. This service is targeted to mainly Indians in India and all over the world. How they do not specifically target US citizens.

 

Also I did not provide any provide any details on the circumstances of meeting my fiance in my I-129F application.

 

Has any one got this kind of RFE ? also any feedback on your case in such matter would be greatly appreciated.

I'm not familiar with that particular website, sorry. But assuming it is NOT an International Marriage Broker (IMB), then you need to provide evidence that they are not an IMB. I got the same thing for OK Cupid (which is not an IMB). From what you described, that website does not sound like an IMB because it's free and you contact each other on your own.

 

I suggest providing the Terms Of Service for the website in your RFE response. I also suggest reaching out to their support team and request proof that they are not an IMB as defined by the IMBRA, then print their response and include it. You can also include a screenshot (if you still have access to it) of the first messages between you and your fiance.

 

You should have provided details of how you first met in person (i.e. face to face) with your I-129F. You can provide a letter to describe how you first met, and optionally include a timeline of your relationship. Be sure to sign and date the letter. Did you provide proof of meeting face to face at least once within the past 2 years? If not, be sure to include this. I met with my husband on shaadi.com, didnt have any issues, i did fromtload the application woth my profile and his as i had them.

 

shaadi.com is more popular and they know of it .  You may now need BM to give you a note that its not an IMB which its not.  Dont worry.

 

Also write a short note about BM and how it works and particularly higlight its very similair to the more popular shaadi.com and usually used by Indian subcontinent to find partners around the world including our own towns.

 

mention in keeping with pur society traditions and arranged marriages work, its a site modern couples us too, to meet partners get to kmow them and comfortably  be able to state that long term or marriage is the goal.

Hello Prish17,

Yes i replied to my RFE and they received it on May 1st, I got a NOA2 approval by US post  with action date of May 12th.

but USCIS status website, still says that my application was received on May 1st and USC will take further action ...... May be once it is moved to NVC , status may change.

Sam, could u please let me know how did u passed the IMB stage of RFE with them. I am under the same boat.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
