Hi:

Can somebdoy recommend me a very good lawyer with experience in filing K1/K2 , AOS but with lots of knowledgement in special situations as public charge, special needs, autism elegibility and so on? I am the K1 and my son who is 19 years old is the K2. The problem is my son has autism. He can talk, read, write but not age apropiately, and he might never be able to work independently so I am concerned about 3 things:

1) Will he pass the medical examination (Lima, Peru)... Do I need to bring letters from his pediatrician stating he is not a dangerous person? (he eventually has tantrums when he gets frustated but he is not in any medication)

2) Will the consul think he might become a public charge? (I will never institutionalize him ) We will have a co sponsor (my sister who is a medical doctor in the USA)

3) Even if we are able to get the K1 and K2 visas, when we apply for AOS, and they see his medical examination in Lima or has to go through a new one in the USA, is there a chance he will be denied it (the AOS)?

We both have tourists visas and have travelled to the USA more than 30 times but I know the requirements for inmigrating are more strict.

I have asked 2 inmigration lawyers and they have told me we wont have any problems but I would like to ask one who has actually dealt with this kind of situation. I dont want to get there, and then having to come back as there is no way I can stay without my son.

I wrote the Embassy in Lima asking if autism would be a reason for denial and they responded this:

"Kindly visit the following web site with detailed information about ineligibilities: https://travel.state.gov/content/visas/en/general/ineligibilities.html"

I had asked them before in twitter openly and they said it was NOT a reason for denial but that was 2 years ago when my son was 17.

So, PLEASE if you know a good lawyer who knows about this could you please let me know so we can start the petition.

THANKS SO MUCH!!!!

Carmen

Not sure if there is anything a Lawyer can do, I can see that the public charge issue may arise.

Certainly I would have details of my plans to cater for his medical needs and future care to be shown if asked, none of us live forever.

That you need a joint sponsor may be an issue, not very much not to need one and obviously you will have extra expense.

Autism is not a valid reason in a denial alone.

There is nothing a lawyer can do to help you with this better then you can by yourself save the money.

Does your fiancé have medical insurance you guys can be put on when you get here? Have you checked prices on places he can be while you work? Just asking since you need a co-sponsor I'm guessing your fiancé isn't making that much just wanted to make sure you are aware of the cost here so you can prove you have it covered so he won't become a public charge.

Thanks for your kind replies. For the K1/K2 my american sister who is a medical doctor is willing to be a co sponsor if needed.

For the AOS too . I own an apartment in Peru and I will be renting it, Does this count ? Also, my son receives child support from his peruvian father.

I dont know if these things can count as the money will be put in my peruvian bank account.

My son is not under medication so he never goes to the doctor. But he wont be able to work I think.

Maybe a letter from my sister stating she will support him and pay his health treatments (he is not on any but still) help?

Letters from peruvian relatives too?

Thanks a lot
