EAD approaching 90 days, now try to expedite with job offer or not

Hello community,

I am wondering how long my EAD will still take. USCIS received my case at  Jan 17 2017, NOA1 dates from Jan 24.
I have a written job offer and I am wondering since I am getting close to the former "guaranteed" 90 days if I shall wait for them to process it regularly or try to place an expedite request.
The company is heading into peak season from this week on, so they would like to have me there working asap. Also my savings after several months without an income are coming to an end (living in the Hamptons, isn't cheap, haha).

Do I risk anything with placing an expedite request?
Does this thing even get to the desk in time where my petition is dealt with?

There has never been a "guaranteed" 90 days for the EAD.  This is just the average time.

 

There is no risk in asking for an expedite.

 

There are millions of cases.  There is no one desk where your file is sitting.  Different agents have access to your file which is digitized and different agents can be working on your case.  The agent who would work on your normal EAD could be in a completely different office from the one working on the expedite request.

I have never seen any part of immigration, whether USCIS, NVC, Embassies, or others, "guarantee" any time frame.

 

90 days is an estimate.

Sorry, but there was something about a change in the back of my mind with all the EAD petitions that came in after beginning of 2017, this is why I wrote guaranteed under apostrophes ;-)

Hey Chris,

I was literally  the same boat as you - my NOA1 was Jan 20th and I had an active job offer sitting there.

I called, asked to expedite based on financial hardship (that's the only option that applies), and stated that I has an active job offer.

They open a case, and say an agent will contact you in 5 days. An email gets sent out and they ask you to fax back their letter, and our letter of employment offer as proof...

My case was just changed to "card in production" .... Woohoo! :jest:

Go for it! It won't risk anything at all. Surely it's seen as a good thing we're out there trying to become immediate tax-paying residents! lol :D

10/11/18....  N-400 interview (Scheduled at original Field Office in CA - we were now in VA waiting to transfer)

10/18/18....  Attended INFOPASS appt to explain my situation and have my case transferred to VA. The Military Liaison Officer in VA was fantastic to work with and had my file transferred with expedite. 

11/07/18....  N-400 Interview Scheduled (technology issue on the day forced us to reschedule appt)

11/09/18....  N-400 Interview - Take 2 - APPROVED!

11/09/18....  Oath Ceremony - *I am now a citizen!*

--- 136days, or 4 months and 14 days from application to Oath ---

I should get the job offer letter today (wasn't formal enough at first -just an email, so I didn't wan't to risk sending that one in) from the company.
Though I am not sure if I really need to expedite it anymore because when I checked back to mycasestatus it says: new card is being produced.

Finally, it seems like my long wait is about to come to an (hopefully soon) end! :)

Thanks to y'all in this thread for input, I appreciated it!

How did this work out for you? I am also approaching my 90 days.... I called 1.5 weeks ago to request my file be expedited but have not received any email.

Hey Courtney,

I did not put in a request for expediting my case, because the day I received my formal employment offer letter, I saw that my status had changed to "card in production". The card arrived 9 days later in the mail. (The very next day I started working, haha. Shows how desperate I wanted to work, so hard to wait for the day to come when I was finally allowed to make money.)
My VJ tracker says it took 94 days for my EAD to be approved, if that is of any help.

I'm afraid I can't help you with your specific question, since I did not place a request for expediting my case, sorry.

FYI - what you are probably referring to in regards to the "guarantee" is the change in USCIS policy on the 90 days. As part of a decision taken in November 2016 (and that came into effect January 2017) USCIS decided to:

"Eliminate the regulatory provision that requires USCIS to adjudicate the Form I-765, Application for Employment Authorization, within 90 days of filing and that authorizes interim EADs in cases where such adjudications are not conducted within the 90-day timeframe."

I am in the same situation. Just called USCIS again, waiting for an agent to contact me in 5 days. Desperately need to get the EAD card for my job. Finger crossed!
