J-1 Visa with CR-1 Visa

Timeline

My stepdaughter, from the Philippines, is here in the U.S. working under a J-1 visa.  She's scheduled to return to the Philippines sometime in July 2017.  She's now met a wonderful man and they will be married prior to her departure date.

 

Does anyone know if she can apply for a CR-1 while her J-1 is still active?  Or does she need to wait until after her J-1 has expired and she has returned to the Philippines?

Timeline

Yes once married her husband can petition for the CR-1 immediately, he doesn't need to wait till she has left.

However, as mentioned, unless she needs to return to the Phils for some reason, they might consider Adjusting Status inside the USA, that way she doesn;t have to leave at all.  We have a forum for that here:  http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-amp-tourist-visas/

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you all for the good information.

 

She is, in fact, required to return to the Philippines once her Visa is expired.  The contract that she signed with her agency requires this.  Otherwise, she will be deported back to the Philippines and prevented from re-entering the U.S. for a 10-year period.
