Hello! I will be arriving in California on a K1 visa soon and I would like to be a functional adult as soon as possible. From what I understand, I can't get a regular driver's license before I get my EAD but I just read that California allows even undocumented immigrants to get licenses and that anyone regardless of immigration status can apply for an AB60 license. So can I take advantage of that and get this kind of license until I get my EAD and green card when I can apply for a regular license? Has anyone done that? Could the police decide I'm illegal if they stop me and I present this kind of license? What do you think?

Thank you!

They guy at the DMV put that out there yesterday to us.  He said that my wife couldn't get a license until she gets her green card but the AB60 thing might be an option.  He didn't know what the ramifications in a applying thru the AB60 would be though.  We aren't going to go that route however.  AB60 was designed for illegal immigrants which my wife is not.

Yeah, I know it was designed for illegal immigrants but it says that everyone, regardless of immigration status, can get it, so that would mean even a US citizen, right? And from what I've read, the law says no one is allowed to discriminate against people on the basis of this license or to decide their immigration status. I'm just not sure how much the police follow this rule, I've heard some not so kind words about the police there and I would like to hear from someone with experience.

My buddy's gf is undocumented right now.  She's here on a tourist visa and overstayed however her lawyer is filing political asylum or something like that.  Well she has the driver license per AB60 but it's tied to the EAD that her lawyer applied for her.  She has to file every year to renew her EAD otherwise her driver license expires also.  So I'm thinking that you would still need a EAD to apply for a California driver license regardless.

The problem in CO was the time it took you would get EAD by then.
