I had an active ESTA visa on my British passport so I entered the usa on that passport, but I want to use my Irish passport for my green card application. My British passport will expire in 2019 whereas my Irish passport was just renewed. Has anyone else done this or can tell me if I need to just send copies of both passports? Thank you in advance

Hi, to the best of my knowledge is that Green cards are not linked to passports, neither passport numbers. You will declare both your citizenships in your application, so I would send both photocopies of the bio page.  Then once you get your greencard, you will be able to travel with your British or Irish as you wish, as long as you present them with your green card upon exit and extry from the US.  When you send your application just explain clearly that you have entered with the British passport and therefore your I-94W Number is issued under that passport.

Your immigration visa IS tied to your passport so when you're at the NVC stage, input the passport number of the passport you intend to use for immigration purposes. 

 

FYI, there's no such thing as an ESTA visa. ESTA is an authorization to enter the US without a visa for up to 90 days.

Due to the little info given, I assumed the OP was already inside the US under an ESTA and doing Adjustment of Status. Therefore I said Green card not linked to Passports.  Clearly we need more info of his situation

I assumed since OP's posting in the IR/CR-1 forum, OP's in her own

contry doing the spousal visa

Thank you for the comments. Yes I entered the USA on the ESTA so I'm already here, and need to start my application soon. But I wanted the green card to be Linked to my Irish passport as I will use it in the future for travel. So for the initial paperwork it asks for a copy of the biographical page of the passport and the entry visa. When sending that I should send a copy of my Irish passport biographical page also? I know this isn't very complicated and I am mad at myself for not doing an ESTA on my Irish passport and entering the USA on that. I really appreciate the comments and help. Thank you

I don't know what the importance is of using your Irish passport. You may renew your British passport from abroad if that is a problem for you. What application are you filing for?

 

Lastly, you did not enter the USA on an ESTA. You entered on the VWP, with the stipulation that you must return home within 90 days. An ESTA is merely a pre-clearance background checking form that, if passed, allows you to get on a plane. But it does not authorize you to enter. It would be helpful if you could clarify exactly what you are filing for.
