I'm in the process of petitioning my mom to migrate here in the US. We are just both confused as to what to put down under her marital status. Technically, yes, she is still married in the Phil. but her husband, my father, filed a dissolution of marriage way back in 2001 in California. So, what should we put down under her marital status? Married or divorced? And will we have any issues with this kind of situation with the US Consulate?

Does your mom have a copy?  If she doesn't have copies can you get a copy from your dad?

 

You will need to provide copies of the dissolution for the I-130 petition and USEM later.

 

 

As for the embassy the CENOMAR is required for the visa application.  And a copy of the divorce would be needed there also.

No, I asked my dad about it and he wouldn't give it to me. He only gave me the case number which I can pull up from the court's website.

You will have to request a CERTIFIED copy from the county.
