My philippine wife and I were married and she came here on a cr1 visa. Her 2 year green card is going to expire and we are collecting all the necessary information to send and apply for her 10 year green card. I already owned my home for 10 years now. She told me I needed to add her to the deed in order to obtain a 10 year green card. She told me her friends were denied a 10 year because other people she knew didn't add their spouse to the deed and there were delays and complications on getting a 10 yr. green card. Has anyone heard of this and should I just keep the deed in my name for now?

You don't have to add her.  It would be a great piece of financial co-mingling evidence but it is not a must.  If you have plenty of other supporting joint documentation ie bank accounts, life insurance, IRA's, etc. you will be fine.  You can explain in your cover letter that you already owned the home prior to your marriage.  Hope this helps.

We are processing our 10 GC and it's been over 14 months now with no answer. Many are experiencing the same delay, but it's only through Vermont  nit California which only takes about the normal processing time of six months.  Just this week they are transferring Vermont's workload to California so your wait time should be better.

 

Now onto your question. I agree with neilsqueen it looks better if she is on but if other items are comingled then you should be fine. My wife is not on the deed to my house and I submitted that bit of information in my package.  I don't know the outcome because our case hasn't been adjudicated.  Nit being on the deed is not an automatic disqualification.

Absolutely not true.  USCIS is aware that many people already own their home prior to getting married.  There are numerous other ways to show co-mingling of assets.

No you do NOT have to add her to the deed.  You need to have two years of receipts, bills, bank statements in BOTH your names.  Utility bills, insurance, bank statements, etc..  for two years, make copies of all of them, and send them off with the I-751 and you will be fine.

Visa chase and citizenship.. DONE!

Is co-mingling of assets really necessary to get the 10-year green card?  My wife and I keep everything completely separate, and we even have a marriage settlement / prenuptial agreement saying as such, but otherwise we're a normal married couple and live together / do everything together just like normal married couples do.  We've only been in the states 6 months (on a CR1 since we were only married 1 year when our I130 was approved) but are they really going to deny her her 10 year green card when we apply for it next year if we still haven't commingled any assets?  Then what would we do, just move to the Philippines together and apply for an I130 all over again and get an IR1 at that point?  Can you apply via I130 twice with the same spouse?

No you do not need to co-mingle assets.  You do need to have a variety of documents for the past two years that you are living as a married couple; utility bills in both names, car insurance and such.. but you NEED two years of documentation or you will get an RFE to provide this.

Well, she doesn't have a car yet, and the utilities are all in my name... (why would they be in hers?) She has a line on my cell phone plan, does that count? :)

You didn't list her on the insurance for the family (your) car?

 

Would your wife having a phone line on YOUR plan count?  Is her name listed on the bill?  NO?  Then... NOPE won't help.

 

Why would she be on the utility bills (ETC) ?   So that when you complete ROC you have... EVIDENCE.  ;)

No, she doesn't have a drivers license.  But I suppose this is good motivation for her to get one.

Is she not a dependent on your health insurance? Beneficiary on life insurance? No joint account?

 

We opened a joint account just 6 months before submitting ROC docs. I wasn't on his car insurance because I wasn't licensed. Wasn't on the rental agreement because we didn't have a contract (good relationship with landlord, she's an angel). We only had health and life insurance and photos of vacations. And a kid. Jury's still out whether we submitted enough but that's all we had. Submitted ROC in July, still waiting.

Yes, she's on my health insurance and life insurance, but our assets are completely separate.  They never asked for any evidence of comingling of assets during the I130 process or interview, and everything was approved just fine.  Maybe we can get some joint grocery store rewards cards before ROC ^_^

Yeah, ROC is a different animal.

We have a joint savings and joint checking then our personal checking. Lots of cards to deal with but it keeps finances mostly organized.

The key here is TWO (2) years of documentation showing both your names, if you have health insurance documents dating back two years or such that should be good.

 

Anything you start now will be useless.

Visa chase and citizenship.. DONE!
