Hello everyone,

 

I just have a quick question for anyone who has omitted a child from a I-129F petition for a K-1 visa.  Could you please let me know if there were any hold ups throughout the visa process after the I-129F was submitted?  Any anecdote would be appreciated.  One member sent me a private message saying that he did not experience any setbacks after omitting a child on the I-129F and there were no issues, but he did mention the child in the paperwork for the embassy and he wrote a letter stating he was aware of the child's existence as additional proof that there is no deception.  I'm just curious to see if any other members can concur with this or if they had different experiences.  Thanks so much.

I did almost the same thing, I omitted because we both misinterpreted the question wrong. I thought if we included his 3 kids we had to pay fees or if they were migrating to USA with him. The mother won't allow or approve, so my fiancee told me not to list them. Now I'm im worried and need to contct NVC before they send my approved pettition to the embassy ?

Here is what another VisaJourney member private messaged me about omitting a child from the I-129F petition for a K-1 visa.  I hope it helps.

 

"There were no issues. It is ok to omit your fiance's child on K1 petition if he/she will not travel to US

But you should mention your child on all paperwork for the embassy and do not file separate forms for the child.

In our case, child was omitted completely in K1 filing and we included her in forms for the embassy. I wrote a letter stating I am aware of child's existence as additional proof that there is no deception.

USCIS will identify child as petitioning for status to make him/her eligible - they forward that information for review to Consulate with your finances case, but it does not mean you need bring the child. Just do not fill out the forms for the child, but mention him/her on your finances forms.

Even after you depart to US, you can adjust child's immigration status under K1 for 1 year, and bring him/her later if you made that decision."

From my understanding, that info contradicts itself. Or, maybe I'm the only one confused by it... If you omit them from the K1 petition then you wouldn't include them in any of the forms or anything pertaining to the K1, maybe just a letter or explanation in the interview that you know of the child but omitted them because they wouldn't be immigrating. So what do they mean by all the forms for the embassy? Wouldn't the forms for the embassy include the I-129F & DS-160?

I agree with CubaandChill that the PM seems contradictory. It states that it is OK to omit a child and were no problems but then goes on to state how letters and documents were sent to acknowledge the child. I think what the person was trying to say when they said it is "OK to omit your fiance's child" was that if a child was not included in the petition it is not the end of the world, it can be rectified.

 

But I agree that it is best to go ahead and contact the embassy to inform them it was done in error and acknowledge the child(ren). Waiting until much later when it is time for you to immigrate the child may cause additional scrutiny.
