To make it short and sweet i was 17 when i got caught smoking weed in public. I was taken in the station, fingerprinted and had to wait for my mom to pick me up. I had teen court a month later and i was to do 16hrs of community service and a drug and alcohol abuse class. After completion my record was to be expunged which it was.

Need some help answering the questions below:

23. Have you EVER been arrested, cited, or detained by any law enforcement officer for any reason?

I selected yes.

24. Have you ever been charged with committing, attempting to commit, or assisting in committing a crime or offense?

I am confused on what to put here since i really don't know if i was ever charged or not.

25. Have you ever been convicted of a crime or offense?

Not sure what to put for this because of my incident. But i would guess and say "no"? Since i did what they required me to do and my record was cleared?

Also, what would i put as the outcome of my disposition?
No charges filed / charges dismissed?

I don't have any of the documents from that time so i am not exactly sure which one it is. I tired to get a police report but they don't have it. I went to district court and had my record checked and it came out clean.

records are never cleared for immigration. records are never cleared for immigration.

23 you would put that you were arrested and explain everything that happened.

24 since you were given community service and a class so I would assume you were cited for something, you can put that you are unsure as to the offense and reference what you were required to do.

25 same as 24 with the dismissed after completing course if that was how it was for you.

it is far better to admit to something that does not matter than to hide something that does. the latter can get you done for material misrepresentation which is a long ban and the drug use is 1 year if they think you are still a user.

good luck

Are these not the same issues when you obtained a GC?

You put yes to all three.

You were arrested, you were charged, convicted.

Your record is clear now but you still were found guilty so you were convicted. They just gave you a conditional discharge to hide your record from the public. Immigration wise they still see it and you will also need your court records.

I went to the police station and they did not have any records. I went to my district court to obtain my records and was given a verified paper that my records are clear. I guess one thing i can do to check my fingerprint records is fill out the background check on the fbi webiste? That would reveal exactly what the immigration would see correct?

What about the court paper that states my record is clean. I only have one and it has an official stamp on it from the court. Do i send that in as well or bring it in during the interview.

i would suggest talking to a lawyer - find out exactly what is on your records and exactly what u were charged with!!! most lawyers do a free consult. if you have your greencard are you trying to naturalize??
