Hello,

 

I'm a green card holder and would like to bring my 16 yrs old son to live with us in USA.

My husband is a US citizen and I'm a green card holder in process (i-751) removing conditions on resident to unconditional permanent resident in USA.

 

My husband is willing to help with filing whatever it takes to help my son to gets here so he can start school as soon as possible.

 

Where should I start to get my son moving to USA from Mauritius.

Is the following-to-join-benefits eligible for us?

We are married and have children together.

 

I'm sure other people has gone through this process before me and i would really appreciate if you can help.

I agree with Georgia.  Have your spouse file for him as a child and that will be the fastest, about 1 year.  If you, as an lpr, file for him, it's 2 years or so.

Ok, i'm a little confused here. I just called USCIS and they told me it's better I petition for my son because if my husband does it will take at least 7 years before he can gets here and if I petition for him it will take at least 2 years.

 

I wasn't expecting that looong waiting time.

 

On top of that my son will have to go to Kenya for interviews etc.. because my country doesn't deal with immigration visa.

 

I know i'm not the only here.

Your husband is a USC it IS best he does it. You probably talked to a tier 1. 

And your son can't come in the middle of it and adjust he'll have to wait home and do medical and interview there.

I have read that you can file I-130 once we received my son NOA1 he can fly here and file I-485.

The misinformation line strikes again! No it wont take 7 years considering his age.  Your husband can petition him faster as a USC step child.   What country are you from? Did you have to go to Kenya?

Doesnt matter. If thats where your immigrant visas for your country are issued he must go there.  You can of course go there to be with him during that time or whomever is looking after him.  I would assume you wouldn't leave him on his own at 16?

Doing some googling you should have went to South Africa?

No but I know how the process works. Ive done a great deal of research on it on the chance my child would want to move here; which currently she does not.  The schools are better where she is anyhow.
