I-131 Rejected....USCIS Reason Seems Inaccurate...Please Help

In the instructions it says:

 

"c. Advance Parole Document for individuals who are currently in the United States:
If you are in the United States, you must attach:
(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole
Document; or

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the
adjustment application;"

Basically, USCIS views the EAD and AP as something that goes along with the AOS, so when you file for AOS you don't have to explain your reasons to want the other two. Just show proof that you have a pending i-485.

Yeah. It was never listed as a reason for rejection so I don't think there was a problem with the way I submitted it. However, when I called the reps were very adamant about emphasizing there being difference between "rejected" and "denied" (when I called in I kept saying I got denied). So it sounds like they can definitely still deny me if they feel my reasoning does not align with how they define an urgent humanitarian purpose.

That's not needed when you file for AOS at the same time (as AOS is reason enough to qualify). And when they resubmit they will add a copy of the i-485, which will be proof enough to qualify for AP.

I realize the second time around the I-485 receipt can be submitted.   I was just asking if the OP submitted it with the first packet. I didn't say it was needed.

Sorry, I wrote "copy of i-485", but obviously I meant copy of the i-797C for the i-485. All these damn numbers.. :D

lol, yeah I got it. Got the wifey to take her passport photos today and will be sending out for sure tomorrow.

 

With your resubmission of your I-765, what did your receipt number begin with? Did you send it to the same lock box? Just curious. Our rejection of I-131 receipt started with WAC so according to the website we have to send it to the lock box in Phoenix, AZ, despite USCIS customer service tracking our I-485 to Missouri and saying we needed to send it there. Again with the conflicting information, can't trust customer service. We are going with the explicit instructions provided online and sending to Phoenix.

All my three i-797C notices (two accepted and one rejected) are starting with MSC. On the rejection notice it explains why it was rejected (because of wrong fee) and in the same sentence it says "please resubmit the application/petition package with the appropriate fees to the address listed at the bottom of this page". It's the same address that I sent the whole AOS package to, the Chicago lockbox.

Yeah I caught that right before I resubmitted....

 

Got another I-797C REJECTION notice today...i'm fuming! It was literally the IDENTICAL rejection letter which included a reference to an incomplete application (the part we've all been talking about does not apply to me) and incorrect payment (which I provided the receipt for pending I-485 for that waives it)!! 

 

Called customer service again and all they can tell me is that it goes to lockbox first before it gets to an immigration representative for judication. Lockbox determines that everything was done correctly before it goes to judication so only they can answer my questions...####### does the rejection letter tell me to call USCIS customer service for then? I've emailed lockbox twice with no response by the way. So angry about all this. Bright side is my wife got her AOS interview/appointment scheduled for the end of March so theres no point in going through this frustration again, really. Just such a damn shame how bad all this was.
