I don't his whole story but I know for fact his case was approved but the PD wasn't current  the time  his dad passed away. I would say he was under f2. You may wanna talk to immigration lawyer. I am not really close to that person to get their personal story.  Sorry.

Then I doubt about it... F2 is different case .... it's totally not possible for other cases...I met with 3-4 lawyers already & case is already denied (revoked)...

I am not sure but I was just to phone with NVC to ask something else regards to my family's case so asked the agent this general question? She told he is the petition dies and the case was approved but waiting for visa. You would have to send in the death certificate and request to your case to move over to other person in your family who is willing to take the financial responsibility.  For example if the father dies and mother or sibling can take over. The PD will stay the same but again it's up to the NVC or USCIS if they accept the request or not.

So this is first step...as soon as you send death certi and other docs...they should pick all the docs and will send to USICS.. NVC will NOT do anything...

USICS will say that it will take 90 days to answer it & normally they revoke the petition..

PLEASE NOTE : DO NOT TAKE THIS AS LEGAL ADVISE . THIS IS JUST WHAT I BELIEVE

You don't have to wait if it's invoiced ready to pay you can. Our IV fee shows active but when I click on to pay it goes to different screen where it shows not invoice yet. So wonder if your's is the same way.

If i was you if the system lets you  pay I would go ahead pay it.

Thanks!!!  Let's wait to see if anyone else knows anything about it.

Everything is moving so fast for me! -- I submitted DS261, and they said it takes 3 weeks to confirm if you don't call them. I didn't call them, and invoice is open, i paid yesterday, i believe by Monday i should be able to pay the IV bill of $325, which I was instructed to wait, until my name appears after CSPA is run.
