Is it possible to cancel a case before it is returned?

Is it possible to cancel a case before it is returned by the embassy?

I have harassed this embassy unend. They sent me a message explaining why our case was issued 221(g). I was able to get this message from the embassy before my congressman could get it from them. I am pushing for them to return the case faster. No news yet.

 

I am considering cancelling the case to refile due to the fact that it takes 18 months to get reaffirmed. I would have sucked it up and waited if only if Ghana embassy would not sit on our case for 6 freaking months.

Anyway, is it possible to cancel this before it gets back?

 

I was hoping to submit all the evidence that were not reviewed at the embassy, with the petition this time around.

I'm sorry for this unnecessary wait. Waiting for the case to be reaffirmed is a story of the unknown. My gut is you should email the Uscis and ask them if it's possible to cancel it before it gets here.  I'm positive they can cancel it for you before it gets back. Good luck

Have no experience with this but maybe you could ask for chief consular (Phillip Franz)review and see if he can explain why evidence wasn't reviewed. Ghana consulars really need to be retrained!

Consul Philip is no longer the consul general there. My congressman submitted an inquiry to find out what was written on our case file. And Consul Philip replied to him with the vague sham marriage quote.

 

But I wonder how I can reach the consul genreal at the embassy at the moment.. Any  help will be appreciated.

Sorry I tried doing a quick search online but I couldn't find  out who the new chief consular is, I don't know if maybe the congressmans office would have access to that.

Title 8. Code of federal regulations, part 103.2(b)(6) states in pertinent part below

 (6)    Withdrawal. An applicant or petitioner may withdraw a benefit request at any time until a decision is issued by USCIS or, in the case of an approved petition, until the person is admitted or granted adjustment or change of status, based on the petition. However, a withdrawal may not be retracted. (Amended effective 11/28/11,    76 FR 53764 ; amended effective 6/18/07;    72 FR 19100 )  

 

So i think you can withdraw your petition now, Just send a letter to USCIS addressed to Mark H. about your intention to withraw the petition and it will be done with no questions asked

Just make sure that you know the reason for refusal, if not addressed (by waiting for NOIR) it may happen again.

Though it may be quicker to refile it may not be the safest route to go.

 

Are you sure Franz Philip Seitz is no longer there ? The Ghana embassy page and his personal Linked In says he is

still there. Remember you can file FOIA for reason(s) of refusal.

I saw  someone named Johnson or Jackson all over the Accra Consulate fcbk page. He might have been the ambassador.

The email i received from my congressman was from Philip Frank-Seitz, the consul general. it looked like he just copied whatever vague clause from 9 FAM 50.2 8(A)(2)(5)(C). Nothing seem like he took a second look.

Yes they aren't very generous with sharing their reasoning and transparency in the process of returns is lacking at Ghana.
