My attorney told me an invitation is not significant until my status is adjusted, I was desperate and tried anyway (several times) and mom's application was denied (we tried before and after I filed my VAWA)

 

I truly wish you better luck than mine but it all depends on your current status  you may overcome this if your child is a US citizen and also your mom's ability to demonstrate strong ties to her home country (other children, spouse, job....etc)

 

 

Note:

I know a girl from Bulgaria who overstayed her student visa yet her sister visited her despite being out of status for a long time it seems some to vary by embassies & officers... nothing is a 100%

I don't see why she can't visit. Let her just apply for a B2. It's different if you are trying to file for her to adjust status but this is not the case, she should be able to get a visa and visit the US regardless of your status or vawa situation.

A lot of people have complained that it's been tough getting visas since trump came into office. Immigration is a lot more strict now.

Timeline

A invitation letter means anything to USCIS.  My friend's husband passed away suddenlly in 2012 and  her mom wanted to  attend the  funneral of her son -in- law and the US Consulate  denied her visa, and she had all reasons to  return such as her husband lives in Brazil, she is a high school teacher and she has 3 daughters living there. Sometimes having ties is not enough either.

I think it depends on where the person is from. My country is not on the list for ESTA

Well she may try her luck to obtain a B2 visa to see you & her grandchild but it's up to the officer to approve or deny.

It really seems at times they refuse just because they can.

Hi, Sandra - 

I hope you can help me. I am really worried because I have not heard about my case for a long time. I am working with an attorney and she filed a ton of documents on May 23th 2016. We got an RFE to provide cohabitation which we replied to on December 2016 with another ton of documents that completely proved that we were living together while the abuse happened. We have no heard anything ever since although they did notify tht they got our answer. My attorney says she won't file an inquiry until the case has been 60 days outside of the processing date on the USCIS website which today is May 9th 2016.  I thought about an Infopass but I've checked at least 5 times and the local office never has any appointments available. 

 

Is a delay like this normal? It's been almost 1 year since we filed and have not had any news so I am very concerned. 

 

Can you please advise?

Caveman USCIS is ajudicating the cases filed in July 2016, your lawyer should inquire or you can goto infopass to see what is going on,but inform your attorney because some attorneys do not want the sef petitoner inquire about his/her case.

Hello sandraj,. I contacted ombudsman because my case for aos under approved vawa has been pending since 08/23/2016. And they haven't mail me an appointment for biometrics.  This is their response:

 

Good morning,

 

The Ombudsman’s Office has determined that USCIS has reviewed your case and issued a biometrics appointment notice. 

 

Please contact USCIS at 1-800-375-5283 if you do not receive correspondence within 10 days.  Please note that this appointment notice was mailed to the safe address that you provided to USCIS. Upon successful capture of your biometrics/fingerprint record, your case will move forward to allow for processing by the San Bernardino Field Office. Because USCIS has taken action, our office will be closing this matter. 

 

Thank you for giving the Ombudsman’s Office the opportunity to assist you. Please consider completing the attached customer service survey.  Your feedback is important to us.

All that notice just tells you is that you have been scheduled for biometrics. After your biometrics, if you filed EAD, they will approve that first within the first 3 months. Takes approximately 3-5 months to have you scheduled for an AOS green card interview depending on how backlogged your zonal office is. Check uscis processing times for your state
