Hello everyone. I stumbled across this forum today due to frustration with my VAWA denial. I filed mid-last year and my petition (I-360/I-485) was denied. Sure enough, I provided a thorough statement over 10 pages, evaluation and everything but using the information from my previous interview with my ex-husband in the California service center. They said there's some discrepancies and my attorney doesn't think we should appeal it but start over. Now I'm clueless because though I'm in a relationship with a great man who has been of tremendous relief through my healing process, i don't want to make a mistake the second time in marriage. I haven't shared the news with him yet cos i just found out about this today. Has anyone here been denied and got approved with another petition. Who knows if my boyfriend will propose in 2017, 2018 or 2019? lol .. trying to laugh a little but im dying inside. so what happens to me while I wait to get married again...whenever that happens!! i dont know what to do. Should I expect deportation or what? i dont know where to find encouraging words at this time in my life. am depressed all over

Berryseed I don't know your circumstances but in my humble opinion you should file a new VAWA petition to prevent deportation because :

  1. One shouldn't count on a marriage that didn't even happen to adjust status.
  2. If you suffered from abuse or cruelty it's not wise to rush into marrying someone else and let history repeat itself.

Refile with the help of legal aid or Catholic Charities(they are good) make your

case stronger, show the marriage was bonafide....Please take time to know a guy

while vulnerable, showing your complete hands  too soon can again find you in a

not so healthy relationship...good luck

Since this is early into VAWA part 7 I thought it would be useful to post some general information links and websites- since not everyone goes back and reads the prior threads.

One of the top concerns in the VAWA thread is legal representation. There are many free (pro bono) or low cost immigration attnys out there that can help you initially file or come on to your case even if you already filed. As mentioned in postings above its better to have an attny in the interview with you. You can use the american bar association directory here- https://apps.americanbar.org/legalservices/probono/directory.html# or the dept of justices legal listings service here- http://www.justice.gov/eoir/list-pro-bono-legal-service-providers-map to start. Services may be limited and/or the attny may have a full case load already so start looking as soon as possible. Call as many as you need to until you find someone.

Another concern is shelter. Call 911 if you need immediate assistance or have already been hurt. Otherwise you can call the National Domestic Violence Hotline at 1-800-799-7233 (SAFE).

You can go to www.womenslaw.org for a state-by-state directory of domestic violence shelters and resources in the U.S. (http://www.womenslaw.org/gethelp_state.php?state_code=AL) This page also has help for how to get restraining orders and local legal aid among other things.

I am posting this question here because, I have an approved VAWA case.

I am currently in deferred action, as I never received my GC as my AOS was pending when I was abused (and now divorced).

 

This is regarding my minor daughter's SSN. Long story short, how can I get one for her?

I have my VAWA case approval and my deferred action letter, but I was told today that I am still unable to get an SSN for her. Is that correct?

If she is listed on your I-360 approval notice as derivative children, you can start her AOS applicaion. You can also request deferred action for her, then apply for EAD and followed by SSN.

ok, thanks...but that raises another question for me.

 

My original AOS (from B2) is still pending (the interview was canceled, but the case still shows open). Do I need to submit another AOS with my VAWA?

 

PS

She was already included on my I-360 and listed in the deferred action.

Sorry, I tried to update my timeline..but couldn't figure out how to do so.

My receipt date was 3/1/16, the prima facie determination (approved) was on 3/9/16.

I was renewed on 10/21/16 (late due to my late filing)

Finally approved on 12/2/16.

 

Should be soon.

I would start a new I-485 based on VAWA approval notice and include in the package your daughter's AOS application. On your I-485, list your previous I-485 and stating that interview cancelled.

As of Nov 30 they are processing for the month of April. You might be very close. Keep us updated if you receive any good news :)

Don't know whats going on i filed on 4th april and still waiting timeline says 11 april
