I filed for ROC in Dec 2015, and my conditional GC expired in July 2016. The case is still pending (thanks, VSC!), so should I get my passport stamped with the I-551 close to one year of the letter expiring (Dec 2016) or the extension expiring (July 2017)?

(Out of curiosity, how were you able to file ROC so early, 6-7 months before green card expiration? For green card by marriage, the window opens 90 days before the green card expiration date. Is there a different window for green cards gotten through different channels?)

Obviously you need the stamp if you're planning to leave the country.

If you're worried about someone checking your status, it wouldn't hurt to get the stamp. Do an InfoPass and be done with it.

Regards,
Bill

I tried doing an InfoPass a few months ago and was told they wouldn't stamp my passport until my letter was expired. What I'm asking is the expiration is this December or next July.

Waivers are able to file at anytime they are eligible to. From I751 instructions "Filing with a request that the joint filing requirement be waived or individually filed. You may file Form I-751 without your spouse if they are deceased, you are divorced, or you and/or your conditional resident child were battered or subjected to extreme cruelty. You may file this petition at any time after you are granted conditional resident status and before you are removed from the United States."

Got it -- thanks for the explanation! I learn so much from this forum. :-)
