GOT A LETTER FROM VERMONT THAT OUR CASE ARE ON HOLD BECAUSE OF SECURITY CHECK

Hi first and foremost I don't want his parole officer to be in trouble for letting him go. My fiance's case even if it sounds redundant but his case was misjudged by the jury during that time. I know there is a lot of people who would think that "all" who went to prison are criminals. But not all of them. Some of them couldn't afford to get their own lawyer and end up the publics lawyer that doesn't do much. Some of them have been misjudged and evidence get manipulated by higher officials. There are so many cases around even here in the Philippines that went to prison and yet they are innocent. The one who did a polygraph to him after almost 10 years in there said he was innocent. But no more use because that is 10 years too late already. The anger management person believed he is innocent so he didn't stayed there for too long. The parole officer that he got assigned to believed he is innocent that's why he going easy on him. I believe he is innocent because aside from what he told me, he also showed me and let me read his record script.

Another thing is I disagree that you said Parole time is still included on their sentence. His state where he is at have a "mandatory" Parole time after serving their time. So they can extract money to them. You may know your situation and your husband. But you don't know the situation of all the "felon's wife". Every situation are different and unique. You may have experienced something doesn't mean others will too. They may have experienced something doesn't mean you will too. It is all different. I believe that its only God who has the right to judge all of us. On the judgement day we all be judged on our sins. We all committed sins, some may be not against the "law" here on earth. But it may be against "God's will and law". Thank you and God Bless.

I wish I knew who this parole officer is who "feels sorry" for people who have convicted crimes and so allows them to break the terms of their parole and go overseas. If this PO is doing that for your boyfriend, who else is being allowed to go on vacations around the world because this PO feels sorry for them? That is not the role of a PO. And you are wrong that parole is not part of his sentence. It is. I'm right. You're wrong. You might not like to think that he is still under his punishment but he is. Parole is not release. It's an alternative form of supervision to assist the transition into society. I see he's brainwashed you into thinking mandatory parole is just a way for the state to get money out of him. Seems to me like he is not sorry for what he has done or he would see parole as an opportunity to reintegrate back into society and start afresh. I wonder what the victim thinks of his PO-endorsed worldwide holidays?

This is aside from the issue as to whether he can legally enter the Philippines with his record. So he's still breaking the law? What a prize of a man he is! Your file being sent to Vermont is the least of your worries. If he carries on like this much longer he will be sent back to prison.

He didn't commit his crime in the Philippines (at least, not that we know of) so your claims of people being wrongfully convicted there mean nothing. He had the option of a trial by jury. He had the option to present his case and explain his actions and any mitigating circumstances. My husband waived his right to trial because he knew there was no point. He was caught red-handed with the stolen money so he pled guilty and took the sentence that was handed to him. There are also appeals. Basically, your boyfriend had a fair chance to prove his innocence (if he, indeed, was innocent). Surely if he was then your "God" would have ensured he didn't go to prison unnecessarily?

Did you meet him while he was incarcerated?

Until "God" is offered a position at the Vermont service centre to adjudicate I-129Fs, there is nothing she can do about your situation.

The likelihood that you are going to find someone with your exact situation isn't great. I would think nonetheless, the person who took the time to post to you could have offered you some help, even in how to cope. Which is what you asked for.

Your opinion that your fiance has done his time, shouldn't have to complete parole and is innocent anyway is fine, you are allowed to believe anything you prefer. Understand though, USCIS doesn't take your opinion, or mine, or anyone else s into account when they follow what the law dictates. Please try and understand that.

And I would have been happy to offer help. In our situation, my husband has a lifetime ban from the UK so we are on plan B which is for me to move to the US. We tried to get my husband a visa for the UK and it was denied with no possibility of appeal and a lifetime ban. For theft. Over 20 years ago. But the UK's stance on past criminal activity is another discussion for another forum.

What I will say is that our I-130 took a lot longer to approve than others that were filed at Nebraska at the same time and we believe that was due to the extended background checks because my husband is a felon.

The OP may have a little more luck with a CR-1 visa, if they can get married. There's no guarantee his PO will feel sorry enough for him to allow another trip to the Philippines to marry her and the OP will likely struggle to get a B2.

OP, maybe this is "God" telling you that this man is not for you. Just a thought. Plenty more fish in the sea.

Because of the security checks required in your specific case, normal processing times do not apply. If you have not already been contacted for fingerprinting, you may be contacted in the near future.

We cannot predict when we will receive the results of these security checks. Please be assured that we will make every effort to make a decision in your case as soon as the security checks are complete.

Its not really clear on when we can hear from them about that finger printing that they would need from my fiance. Plus isn't it the main reason why we got transferred in the first place? Because they say my fiance's record? I really don't understand what kind more security checks they needed to find out? Please VJMembers, if any of you had the same situation like ours, please let me know what to do and what to expect. They said 'Normal Processing Time" do not apply in our case. That means that even if VSC says within 5 months for I-129F that doesn't mean we can get approval within that timeframe. Please please help us. Thanks all in advance and God Bless...
