Dear friends and immigrants who know or went through the same process, please advise:

I received my conditional GC in Jan, 2012 based on marriage to US citizen. Soon after marriage my life turned into nightmare when my husband started to abuse me. It lasted for a certain period until I decided to run away to stay alive.. I filed petition under VAWA and also filed for divorce. I got approved for a 10 year GC based on VAWA and also by that time I already received my divorce decree (Jan, 2014).

Now I am planning to apply for citizenship based on 5 year rule of being a permanent resident. I was never aware of a 3 year rule for battered spouses, but it's okay, I didn't rush into anything.

Now I have a few questions:

1)When selecting grounds on the application, do I choose the first option (being a resident for 5 years) or I need to choose "OTHER"?

2) In my specific case, what additional docs do I need to enclose with my initial application?

Please guys help me to figure this out, I am a bit confused right now.

Choose 5 years, because it is much easier. Then you don;t ned any extra documents, just show that you have been resident 5 years, and that you didn't spend too much time abroad.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Please could you let me know if you were successful filing under the 5 year rule as I'm in the same situation but have had my card for almost 10 years.

Prima facie determination received from Vermont 20th Nov 2005

DIVORCED JANUARY 25th 2006

EAD applied for again (jeez I need to work ) 28th Feb 2006

Removal hearing July 12th 2006

RFE's received for I360 and EAD 13th October 2006

NOID received March 2007

EAD denied March 2007

Back to Immigration Court April 18th 2007

NOID request for evidence received USCIS 3rd May 2007

I 360 touched May 31st 2007

I 360 actually approved May 30th 2007

EAD filed June 23rd 2007

I 485 filed July 24th 2007

NOA1 for I 485 August 1st 2007

EAD approved August 6th 2007

Medical with CS August 28th 2007

Biometrics August 24th 2007

Paperwork sent to Immigration Judge to finally terminate removal proceedings September 10th 2007

 

GREEN CARD FINALLY APPROVED AFTER 4 YEARS September 9th 2008 :D

 

N-400 Filed online 03/04/2018

NOA online 03/05/2018- projected Citizenship completion date December 2018

Were you successful in using the five year rule, as I'm in a similar position, but had my GC almost 10 years.
