I-864 Assets

From what I've read, I can sponsor my spouse if I have assets that total five times the difference between the minimum level of support--125% of poverty level and my income. While I'm starting an online business and will have some income before returning, I won't be able to show three years of tax returns from that business. So I assume they will treat my income as zero. My assets are well above the threshold. Most are in retirement accounts, but I can access them as needed as I'm 60. I also own a home with significant equity.

I'd appreciate hearing from anyone who has sponsored their spouse using just assets. Or should I just arrange for a joint sponsor?

When sponsoring a spouse using just assets, only 3x the difference is needed. If the home you own is your only home, it may be disallowed because its liquidation it in the event of the terms of the I-864 not being met would cause an undue hardship to you.

they are looking for 3 years of tax returns from whatever job you have had

You say spouse so are you doing CR1 or K1 intending to marry?

Telling these things will help with the answers you need

Filing the application now will need tax returns for 2016 as interview will be along this time now in 2917 if you are married

if doing assests, need a real property apprraisal done and proof showing you owe no motgage (can be shown on homeowner's insurance statement showing no mortgage ), other assets such as 401 K, investments are also accepted

Sorry I wasnt clear. My wife and I have bern married for almost five years and have a four year old daughter. I've been working abroad for 11 years and have filed returns every year, the last 4 jointly with my wife who has a US TIN. But little of the income shown on the returns will relate to income in the US.

My wife owns a home in Phnom Penh that we had built a few years ago. It's paid off. My home in the US has significant equity, but is not free and clear.

I'm not too worried about the IR-1. We're legit and can prove it. But I do need to know if I'll need to arrange a joint sponsor. As I said, I have assets in brokerage and retirement accounts well beyond the amount required. I just want to make this go as smoothly as possible.

I believe that your home in Phnom Penh would qualify as an asset. retirement, cash in bank account and stocks.

any of those combined equals to 3 times the poverty guidelines on I-864P would be good.

It's more likely that foreign real estate will be disallowed as an asset because it couldn't easily have a lien slapped on it or be seized should such a step be necessary.
