Hi guys,

I really need your help guys, this is my story about our visa process.

Me and my fiance have met on May 2015 here in the Philippines for only 7days and he filed a fiance visa on July 2015 but unfortunately we got denied on our interview in US Embassy Manila because of non-declaration of his criminal record but this was fault of his attorney. And then we refiled on January 2016, on October 12 we received an RFE which is "multiple waiver" and we don not know how to make it. Is there any one of you have the same situation like us? Please please guys help us!!!...And one more question, we've met only one time last May 2015, does he have to come and visit me again or come with me on my interview? Your comments and advice are highly appreciated. Thanks in advance?

If you have had an approved I-129F petition within the last two years, you'll have to submit a request for a waiver if you apply again within the last two years of your previous I-129F. Since it's only been a year or less, a request for waiver is needed.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

This a stressful time I'm due. Don't trust your lawyer because he just you headaches. You should have reviewed your documents for accuracy. You will have to request a waiver. Follow the link from above. You guys can do this whole process over again but do it yourself and both of you look it over for errors before submitting your documents. There guides here to help and many who have completed their visa and can help.

Meeting only once is not a issue, most only meet once before filing. Being at the interview always is a plus... if you have completed all the requirements correctly.

Lawyers seem to cause more issues than help in this process. The process is mostly reading the instructions and completing the forms, including required additional documents...

Here is the info for what you need to do: Page 3, section 3b of the I-129F instructions lists the requirements for the multiple filing waiver: https://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf

It is basically a letter requesting a waiver, explaining the reason why you are requesting this waiver.

Very possible USEM will kick this back to USCIS as the petition was approved without this waiver included.

The example letter from the other link is good, do make sure to go into detail regarding your previous petition

RE: General Waiver for multiple filers

To Whom It May Concern:

In compliance with the International Marriage Broker Regulation Act (IMBRA), I respectfully request a waiver on the filing limitations in connection with my current petition. A waiver is appropriate in my circumstance because I have no criminal history with regard to the “specified crimes” under IMBRA.

I have one prior approved Form I-129F for [NAME], receipt number [RECEIPT #]. This petition was approved on [DATE], and resulted in...

Evidence to support this waiver includes:

[YOUR EVIDENCE]

Thank you for your kind consideration of my request.

Sincerely,

Explain what happened with your previous petition, and include evidence to support it. You say the first visa was denied, then include as evidence the denial notice which states the reason you were denied.
