RFE never received in the Mail

We filed AOS in March 2016 and we were mailed an but never received. According to the USCIS website they mailed the RFE on August 31,2016, on September 14, 2016 we didn't receive it in the mail so I submitted a request to have it mailed again. According to the website it expires on September 30, 2016, and on September 29, 2016 I called the USCIS to find out when it was going to be sent, I was told to call back in 15 business days. We are still waiting now it's October 11, 2016., and still getting the run around. How long does it really take to receive an RFE, Just wondering we the send a denial letter for not responding on time.

Make an infopass, ask for a real IO and ask if they can start the RFE clock over.

For the future put the applicant's name on your mailbox.

Call and ask to speak to a supervisor and have him or her fax it to you. That is what i did cause same thing happened to me.

I made an Infopass Appointment for October 27, 2016, that's the earliest appointment they had. We will see how that goes.

Call and ask to speak to a supervisor and have him or her fax it to you. That is what i did cause same thing happened to me.

I don't have a personal fax machine, And I don't want it fax to my job since I only work weekend nights, I don't want it to get misplaced or thrown away.

I filed all the documents as they requested in the petition for my parents (i-130) I had been waiting months and months and every time I inquired they said my case was pending action but never updated the system to let me know that they had send a RFE. I called and talked to an officer who said they had put the petition on hold until the received the evidence they requested and when I mentioned I never received it in the mail they said my petition would probably be denied because the due date to respond had passed and they don't issue extensions. They refused to resend the RFE letter and now I don't know what will happen.

Does anyone know how long they usually take to deny a petition if the petitioner fails to provide the evidence they requested? I just want to file again and I am SO frustrated because this was their mistake and now I have to pay for that.

Make an infopass a.s.a.p and request to speak to an immigration officer, not just someone behind the counter and not on the phone.

Did you change your address lately ?

Do you have proof of your inquiries you made thus far ?

Usually you have 90 days to answer a RFE.

Put the applicant's name either on the outside of the mailbox or inside so it is visible to the mail carrier, lots of RFE's

have been deemed 'undeliverable' because the post office returns mail from USCIS unless the name is on the mailbox,

not in most cases but in many.

In order to make sure you will receive any correspondence from USCIS mark your mailbox with your name.

I understood that you did not receive it, therefore for next time mark the mailbox.

You never received a denial letter either so there has to be a mail issue (change of address or they need name on box).

When you go to the infopass ask to speak to a real immigration officer not just anyone behind the counter.

Request they reopen your case since you never received anything nor was the web site updated.

Thank you. I get it now.

I haven't received the denial letter yet because they haven't made a decision. I should receive it soon. I called them today and they said they should be about to make a decision on the case without the requested evidence (which of course will be denial I am pretty sure).

I am going to do as you said. This is so annoying!

Hi guys,

I have an update.

The reason why my petitions were kept on hold as I said in my previous post was that they sent a RFE back in June and I never received it. They never updated the website. Anyways, I requested that they sent me a copy of the RFE letter and they said because the time had elapsed they could not fulfill my request.

I am writing this to give hopes to all the people who might be in my situation. Two days after they said they would not send the copy of the RFE letter I received a copy in the mail, together with a letter saying that they were expecting my response and if I did not send it they would deen my petitions abandoned and in this case I am not allowed to appeal I would have to refile.

I rushed to read the letter, what they said was that my Birth Certificate was a "Later registered certificate" and they asked me to provide other evidence of my relationship with my parents that would convince them that I was their daughter.

The thing is that my Birth Certificate is not late registered, my birth was registered one month after I was born, they confused the date I ordered the certificate at the government office in Cuba with the date I was registered. And of course it appeared like my birth had been registered in 2016! What a crazy thing!

Anyways, I took a copy of my birth certificate again, together with a new translation signed by someone else (It could have been that the original translation was faulty), I wrote a letter stating that there might have been a misunderstanding, I clarified everything, plus I attached two affidavits from my grandparents stating that they were witnesses of my birth to my dad and mom and that my birth was registered in the date that appears in the certificate the same year I was born. I included all that with translations and certification by the translator (which can be done by anyone fluent in the two languages used, except for the petitioner or the beneficiary), I also included the original RFE letter and the other letter they sent and I sent the packet next day delivery.

Today my two petitions were approved!!!! One week after they received my packet.
