hello there...i am on visitor visa for ten years, and i am a canadian permanent resident, but i am married now with US Citizen, my entry was for 6 months, that is expiring today, my question is -should i apply for my green card straight or should i go to stay extension ...i am confused...please somebody help

hi

you can't file an extension after the i94 expired or length of stay expired

but don't worry, overstay is forgiven when married to a USC and have entered legally to the country

aleful thanks for your reply...i came in car..and when i can apply for my green card, i would be illegal ( i fear ), and i want to apply for my things asap, but how should i proceed , as lawyers are very expensive to go to..i am afraid of being illegal, though i am married to a USC. i need to know about the forms i need to fill and do i need to send them in mail or is there any method i can do that online electronically...i dont want to make any mistake...

You are illegal as of today.

What were you doing the past 5.29 months? Your hubby has to gather evidence of your relationship, and mail the paperwork ASAP.

While overstays for USC spouses are forgiven, you are out of legal status until the day your hubby sends in the paperwork.

It seems you have expertise beyond immigration law and into advanced math. :)

OP, like most everyone has told you, file the concurrent I-130/I-485 and all supporting forms and documents ASAP. And don't be tempted to leave the USA. Stay put till you have an approved AP document.
