My dad applied me as originally as F3 because I am married. Currently I have divorced, wanted to come over soon.

Since I was original filed with F3, can I upgrade to F1? Do I keep my priority date? Is there a way I can ensure that my priority is kept? I don't want to lose it.

My dad is citizen when he filed F3 for me.

you will always keep your priority date, you have to send a copy of your divorce decree to nvc with your case number and explain to nvc that you've divorced so they change you to the other category

I assume I need to get divorce decree in English right? I am from Malaysia, I think the stuff is in the "Malay" language, i need to check.

One more question, my son is under me. Am I able to bring my son over? He's 1 year old.

Sorry, I am in a panic mode, let me summary it.

I am now divorced, but have a 1 year old son under my name.

Am I eligible to upgrade from F3 to F1 still? Am I allowed to bring my son together with me?

I think is towards the end of 2011 is my PD. Do I have to file something special for my son to bring him over when I get my GC under F1 Family Visa ? Is it immediate or I need to wait for my 1 year old. Please provide recommendation, I dont want to be separated from him.

Thanks. Or most likely my ex-wife would not be able to attain a visa since before she was in the F3.

That is a whole other situation.

You can NOT guarantee her a visitor visa. if she can't get it own her own like everyone one else she is out of luck.

She can visit, provided she gets a visitor visa. A visa is never guaranteed though.
