Hello

I'm looking for some advice on filing the I-130 for my husband. I'm trying to figure out if I should save myself some money and file it myself or if I should play it safe and pay a lawyer $1800. here's the story

We have been married for almost 2 months but we have a daughter that will be 3 months soon. My husband entered without inspection therefore we will need to file a 601 waiver for which I am planning to pay lawyer. We have bank statements and affidavits from our friends to prove the bonafide marriage. Will this be enough?

If you're a US citizen then the I-601A is superior to the I-601, if illegal presence/EWI is his only inadmissibility.

You would need to file the I-130, wait for its approval, pay the NVC fees, then file the I-601A. After it's approved, he would then travel to his county of origin to interview for an immigrant visa.

Not normal for Waiver Lawyers to give any/much of a discount, the ones I am familiar with need/want to do the full thing.

What is needed, well without full information I will not comment further.

You could do it yourself, but it's not something I would recommend.

At the very least, you should consult with a competent waiver attorney, such as Liz Cannon, who is highly regarded here when it comes to waivers.

I am in the same boat (i130 then I601a) and I regret not doing the I130 myself. It cost me $1k with the lawyer. I am planning on doing the I601a myself with the help of google and the i601a facebook page.

04/19/16 PD - NOA1 (Potomac Service Center)

07/13/16 Transferred to National Benefits Center to "speed up" processing

08/06/16 Transferred to Local Field Office (Philadelphia) for Marriage Interview

10/04/16 - Congressional Inquiry

01/05/17 - Ombudsman says will receive Interview letter within 30 Days!

02/01/17 - Marriage Interview

02/02/17 - I-130 Approved!!!  :D

The I-130 is simple. The I-601/A less so, but some have done it themselves, with varying degrees of success.
