My wife and i we have joint sponsor to sponsor us but my wife is required to fill the 1864 form and provide supporting evidence.She was unemployed in 2013,2014 and worked in 2015 for 4 months but she never filed for taxes .We are stark and not sure how to proceed .She has prepared a a letter stating she was unemployed in 2013,2014 and thats reason she never filed for taxes but now comes the problem with 2015 .We both very stressed about this issue.

If her income was above the filing threshold, she needs to file taxes for 2015. If her income was below the filing threshold simply state that fact as a reason for not filing in the same letter/statement where you state her reason for not filing for 2013 & 2014.

Yes she has to file taxes if she was required to, even with a co-sponsor; the CO will want to see nehr be law abiding in this regard. She cnan backfile, it is not a problem.

We do have joint sponsor with all supporting evidence but since she never filed for 2015 would that lead to denial of the case saying 2014,&2013 i didn't file because i was unemployed and 2015 i did not submit

How long has the co-sponsor had their new job, and is it long term and stable? Can they provide paystubs for 6+ months?

I think i might have confused you.The joint sponsor is not one with tax problems.Its my wife that had not filed for taxes in 2015.My joint sponsor has had stable job for more than 7 years.My problem is can he still submit and get approved i864 of petitioner without her w2 for 2015 plus that with joint sponsor with supporting evidence

No. As you were told already, if your wife was required to file taxes, she must file them, otherwise your case will not be approved.

How much did she earn that year, total?

There is such a thing as filing threshold. If one's income is under that in a year, then one is not required to file. That's why we keep saying that IF her income was above the filing threshold THEN she needs to file.

her hours were never consistent i would say maybe 30 hours and it was $7.50 not 7.25 .what happens then if she was above the threshold and never filed .We are trying submit all documents but we worried about this part even though we have a joint sponsor that has adequate documentation .

Once more:

IF her income was above the filing threshold she MUST file her taxes. No ifs or buts about it.

IF her income was below the filing threshold she should simply state this on the same statement where she stated she did not filed taxes for earlier years because she was unemployed.
