Hello,

I want to ask a question that “my wife is US Citizen & as a main sponsor she has to fill the form I-864 but the problem is that she didn’t do full time Jobs for the last three years as she was college student or remain most of the time at home and only did part time Jobs in Holidays. She also didn’t file tax returns for last three years and at present she is unemployed, so what should we have to write in Part 6 of form I-864: Sponsor’s Income and Employment

4- Unemployed since_______________

5-My current individual annual income is _____________

Also what to write in line number 13

Tax Year Total Income

13(a) ______ 13 a.1 ______

13 (b)______ 13 b.1 ______

13 (C )_______ 13 c.1 ______

Another question is that we have Co-Sponsor my father in law in this case, my father in law has to fill the form I-864 or I-864A? or if my father in law’s income is less than poverty guidelines then can we attach/add another co-sponsors in this case? Means my brother in law plus (+) my father in law can both be joint sponsors? If yes then both have to fill form I-864 or I-864A?

Yes wife files 1864 co spencer files i864A

And yes if income is not at poverty guideline co sponsor needed.

I think you can have up to 3 or more co sponsor I could be wrong.

If she did not file tax put 0 and write a reason for not filing.

Family member in same tax return / dependents incomes in same household goes in to same i864 I think.

But You can have sponsor that is not related to you or your location but they have to fill out separate i865 A

But You can have sponsor that is not related to you or your location but they have to fill out separate i865 A

You canNOT add different joint sponsors' incomes together unless they live in the same household. If they do, one of them fills out the I-864, the others who live in the same household fill out separate I-864As.

The only time you can add several people's income together on the same I-864 is when the intending immigrant is the spouse of the primary sponsor, then the intending immigrant's income (if will continue from the same source after immigration) and assets can be listed on the sponsor's I-864.

OP if and only IF your FIL and BIL live in the same household they can both be joint sponsors. One of the fills out I-864, the other I-864A and their incomes are added together.

Ok, thanks a lot, I understand it now, means my father in law and my brother in law can both be my joint sponsors, one has to fill I-864 and other has to fill out I-864A?

Another question is that any USA Citizen can be my joint sponsor if he is not house hold member? If joint sponsor is not house hold member then he has to fill out I-864? Am I right?

Also please tell me still I have confusion regarding following part of form I-864. Your question indicates you have not yet carefully studied the I-130 instructions or the I-130 filing guide here on VJ. Doing both, will be critical to your ultimate success. Asking questions helps but doing that alone will leave you never knowing what you didn't know, until it's too late.

The affidavits of support are the most complicated forms you'll deal with in this process. Getting them right, in your circumstances is going to require lots of detailed study of the forms. Which form to use for whom, is critical, but so is completing them correctly. A clear understanding of the instructions is key, but even then you'll still probably have questions. We can help you better if you've first studied the instructions very thoroughly and carefully.

Your question indicates you have not yet carefully studied the I-130 instructions or the I-130 filing guide here on VJ. Doing both, will be critical to your ultimate success. Asking questions helps but doing that alone will leave you never knowing what you didn't know, until it's too late.

The affidavits of support are the most complicated forms you'll deal with in this process. Getting them right, in your circumstances is going to require lots of detailed study of the forms. @pushbrk I am in tension and study these forms day and night but as a new comer it is very difficult to understand all this. If you cannot help me or others then please don't write such long paragraphs which don't help me understand anything and have no answers.

@pushbrk I am in tension and study these forms day and night but as a new comer it is very difficult to understand all this. If you cannot help me or others then please don't write such long paragraphs which don't help me understand anything and have no answers.

I was referring to the instructions for the I-864, not the form itself. Regardless of your dismay at reading long paragraphs you don't understand, you'll find the I-864 instructions full of long paragraphs, which you MUST understand.

Once you've studied the instructions, read the questions on the form carefully, interpret them literally, and answer accurately. Hint, the "current income" question is a present tense question, so unless your wife is self employed, "past income" from "last year" has nothing to do with the question on the form. Answer indicating her "current income".

Facts are cheap...knowing how to use them is precious...
