Preference Category should be CR-1 but NVC updated case to IR-1 ?

Hi all,

I became U.S citizen two months ago and sent a request to update my case category from F2A to IR-1/CR-1, which I filled last year. Due to lack of knowledge I wrote "Please upgrade my wife, AABBCC, from category F2A to immediate relative, and proceed with case processing." lo and behold, that's what they exactly did .... Preference Category: IR1.

Now it hasn't been two years since our marriage, and recently I found out about the IR-1 vs. CR-1 criteria. Yesterday I called and talked to an extremely polite gentleman at nvc and explained that I noticed that my category is IR-1 and should be CR-1 since we haven't been married for more than two years. He stayed quiet for few seconds and then I said "I don't want to cause any delay but I wanted them to take a look at it". The guy said that these calls are recorded and appreciate my honesty and straightforwardness but I would rather leave it alone. Then he verified my DS261 form and today I paid the $320 "IV fee".

Now my question is what to do in this situation? I would absolutely hate to delay our case any longer, should I wait till she get her VISA and then contact embassy? Tell my wife to explain the situation in her interview? I am just looking for the best option. If I leave everything as is, my wife still be able to come to united states? then once she is here I can deal with USCIS/NVC and pay extra fees and stuff. I don't mind doing any extra paperwork or paying fees later ..... I just want to be with my wife cuz I miss her very very much.

now, when is your 2 year anniversary? if when she enters the country you have been 2 years married then there is no problem

but if not, then she can change the card

Well the way things are going, hopefully she will be here before our 2 years. I am planning on submitting the AOS/Financial documents this weekend and hope she will get an interview date within a month or two. Our anniversary falls in April.

They will have the correct category when it goes through NVC and in to the embassy. Ours was automatically updated from CR to IR when our 2 years was done, they check it at the interview.

Ours came as CR-1 from NVC, even though we had been married over two years at that time, but the embassy changed it to IR-1. Just have your wife point it out at the interview, so it's cleared up before she gets her gc. You don't want to do it when she has her gc, cause then it becomes a long mess.
