Hi,

My finance just submitted I-129 form to VCS on March 13 . I thought it will be as faster as getting a B1/B2 visa since I have been to states for study and business many time before we started I-129 process. We planned to get married by the end of April either in Taiwan or States, but it is obvious that we need to postpond our plan.

My questions to everyone are :

1. How long does it take to let me get a K-1 visa ?

2. Is there any possiblity that I can finish the whole process by the end of April since I still have SSN# and bank account in States. Our case is much easier that we live together for 1 years in States and I have been to states over 10 times before.

3. Can I use B1/B2 visa to enter States and to plan my wedding after filing I-129 as a benificiary ? Will they prevent me to enter ?

I am losing my patience after I read everyone's story. Why they make is so hard to let a real cople in love wait. I miss my finance so much....All I want is to be with him forever.....I hope all this can finish asap.

1. 6 to 9 months, see Immigration Timelines for better guidance on your particular situation.

2. None of the information you mention is relevant to Visa processing.

3. Yes, they might, you should come with plenty of evidence substantiating you current non immigrant intent.

You would be better of posting in the K1 forum, lots of people there in a similar situation.

January 2005 - Met Annie online

February 13th 2006 - Met in Real - WOW!! Ikaw maganda!

February 14th 2006 - Proved I was really serious, proposed to Annie - She said "Yes"

February 2006 - January 2007 - Both working, saving, planning. Continuously chasing Annie online, on phone...

January 22, 2007 - February 4th, 2007 - Together again in Philippines, working on paperwork, visiting family.

February 27th 2007 - I-129F Mailed to Nebraska

March 6th - NOA1 Received.

May 23rd - NOA2, Received Approval Email

June 14th - Receive letter from NVC, packet on the way to Manila Embassy

July 30th - Annie receives packet from Embassy, appointment scheduled for September.

August 29th - Annie survives Blood Draw, Injections, and successfully completes Medical at St. Lukes.

September 13th - Annie is a huge success at the Embassy, SHE IS APPROVED!

September 20th - Visa in Hand, tickets purchased..

December 18th - Jumped on Airplane, Philippines for Christmas and New Year's.

December 27th - CFO Seminar Succesfully Completed

January 8th - Jumped on Airplane to USA together, Seattle POE, arrived home to Kansas.

March 14, 2008 - Married

May 19, 2008 - AOS NOA1 Recieved, Biometrics scheduled for June 18.

You may finad approval through VSC quickly (less than 30 days), but some petitions even with VSC can take months to approve. Add a week or 2 to get through NVC and then it all depends on the timing at the consulate. You can check timelines on VJ specific to Taiwan to get an estimate.

About entering the US- you can enter, but need to understand that even with a legitimate visa, you can be denied entry. There are several posts on VJ from people who did travel during the process. You can get some good advice abotu how to travel and increase the likeihood of not being denied at teh POE.

The wait is due to the number of petitions being processed (somewhere around 200,000-300,000) and extra checks to weed out fraud and those people with terrorism connections or significant criminal history.

While Vermont may process your petition quickly, it will take up to a month to reach the embassy, and looking at the Taiwan data, about two months after they receive the petition to schedule an interview. If you were to file today you could have your visa in about 4 months if don't run into any snags. But there is always a chance something could hold up your case.

Having a social security number is pretty much only going to allow you to file for AOS a bit sooner than you otherwise would. But it wont help speed up your visa petition.

Yes you can travel to the US on other visas. However, if you cannot prove significant ties to your home country, you may be denied entry. Overstaying other visas could while a K-1 is being processed could hold up your K-1.

If you have already made plans for a wedding in April and you cant back out of it now, you could go ahead with a non-legally binding ceremony. You do have to be careful with this though, don't wear wedding ring, and don't refer to each other as husband and wife to immigration officers. Its none of their business if you have a non-legal ceremony, don't give them any reason to suspect that you may have already had some kind of a wedding.

The other option is to just get married, and file for K-3 or CR-1/IR-1. Being your wedding plans are in April, it may not make much of a difference.

You do not need to have a social security number to file for AOS. You can write none in the space.

WE sent K-1 application on March 13 ,2007 to VSC but got nothing return so far. The only evidence that they are processing my case is they cashed the check on March 20, 2007. We also checked with the post office and found out the document arrived on March 15. I really dont have any clue. I saw others got NOA1 or even more notice from other service center , but we even dont have notice number to check. Can we use the registed # issued by USPOST to ask VSC? Someone can help me out? Thanks!

I would suggest a timeline search for filers thru Vermont with beneficiaries from whatever country you are from

btw .. your timeline says that your case may be adjudicated as soon as April 17 (NOA-2) ... figure 3 months after that for taiwan and it should be close, but I wouldn't make any plans with that date in mind just yet .. it is best just to wait
