Do you have any estimation of how long it will be before your spouse becomes a citizen? You said he is "applying" does that mean he already sent in the application or that he is going to soon?

If i get out of the country and he becomes a citizen..he can ask me as his wife and I'm not gonna have a problem or is better if I'm in the country?

If you leave as soon as possible no it shouldn't be a problem, but the process takes about a year. If you stay and wait until he becomes a citizen you're here the entire time.

It's immigration. Money, background checks and time is what it's all about.

Looking at some of the timelines here is looks like there are a few May bio appointments that are just having their interview appointments now in July.

If you wait until his appointment you'll have a 3 year ban if you leave the country FYI

If you leave and have overstayed 180+ days yes. Waivers can be filed for extreme hardship for a fee

The problem is you leaving.

It's certainly a risk as you are out of status. I am not going to pitch a fit and tell you to get out of the country or anything, but the chance of being banned for 3 years if you do have to leave for whatever reason is something you should seriously weigh in your mind.

If he was a citizen for the entirety of your marriage/overstay it would be forgiven, but I don't think it is applied retroactively if he becomes a citizen later.
