Hello VJ Community!

I'm in the process of adjusting status for my K-1 Fiance (now wife) and her daughter who arrived on a K-2 Visa. I'm gathering all of the paperwork together to submit to

UCSIS, the I-485, EAD, I-864 Affidavit of support, and other paperwork necessary. Do I need to submit a separate I-485 form for her daughter? I'm aware of the fees involved.

However, when I went to pay the USCIS Immigrant fee online for the both of them, I was not able to locate the DOS numbers for my fiance and her daughter. From what I've read, this

was something that you are supposed to receive from the consulate that you interviewed with. In this case, Lima Peru. My wife does have an Alien Number on her I-94, but her

daughter does not. I'm guessing that is not normal. I have looked up information on the USCIS website about how to find your DOS number and what the forms look like. We cannot

find the documents shown on the website. Is it possible that the embassy forgot to issue the numbers upon successful completion of the K-1 Visa interview?

Anyway, I wrote an email to the US Embassy in Lima, Peru to see if they can provide some assistance with this. I hope to hear from them soon, as I need to pay the USCIS Immigration

fee before we get the green cards produced and sent out, as per USCIS regulations.

Any information would be helpful and appreciated, thanks!

The daughter needs a separate I-485.

They don't need to pay any immigrant fee. Those are for people who entered the US on immigrant visas, not for people who are adjusting status.

Thanks for the response, but are sure they don't have to pay? I read the fee is $165 per person on the USCIS website. The cards will not be issued unless the immigration fee

is paid first.

That fee is for people entering on CR1/IR1 or other visas where they become LPRs on arrival. K1/K2s have to file AOS (with another set of fees involved) before they can get their green cards.

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens

That fee is for people entering on CR1/IR1 or other visas where they become LPRs on arrival. K1/K2s have to file AOS (with another set of fees involved) before they can get their green cards.

And those fees are the $85 Biometrics fee and the $985 for each I-485 form, correct? A total of $2140.

Indeed. For individuals 14 and older that is true. If your K2 is below 14, no biometrics fee is needed. If you are filing the paperwork for both of you together (same envelope) and he/she is younger than 14, then the fee for him/her is reduced to 635.

If it isn't difficult, it isn't worth it.

A K-2's A# is unknown until after filing for AOS, so leave the A# blank for the K-2's forms.

The fees are listed on the same page where you download the I-485 forms > https://www.uscis.gov/i-485

Look under Special Instructions. A child under 14 filing with the K-1 parent is $635. If they are 14 or over, then yes, another $1070.

And yes, the people answering above are correct, you do not pay the immigrant fee when entering the US with a non-immigrant visa, which the K-1 is. >

The following groups do not have to pay the USCIS Immigrant Fee:

  • Children who enter the United States under the orphan or Hague adoption programs;
  • Iraqi and Afghan special immigrants;

Yes they do already have one. The K-1's A# can be found on the NOA2 approval notice for the I-129F petition. It is above the beneficiary's name.
