Hello Everyone!!!!! I have a quick question regarding the AOS interview.

My husband and I have our AOS interview scheduled for July 14, 2016. Below is some background information:

My family and I traveled to the U.S.A. in 1998 on a tourist visa. We overstayed our visas. I went to elementary, middle, and high school in the U.S.A. As soon as i finished high school in 2009, I returned to my home country (Mexico) to start College. Because I lived in a border town, i applied and got approved for a border crossing card/tourist visa in 2011. After two and a half years of studying in Mexico,i found that I wasn't particularly satisfied with the education I was receiving. I decided to apply for an F1 Student Visa. I was approved for my Visa in July 2012 and moved to Tampa, Florida. After two years of school and completing my A.A. degree, I was convinced by my advisor to take a one-year break to fulfill one of my lifelong dreams: working for Disney. I applied for OPT, which allowed me to work for Disney from January 2015 to January 2016.

While I was applying for the Disney College Program in August 2014, I met my husband through a Facebook group geared specifically towards finding roommates for the College Program. I had roommates but we created a nice friendship. I was scheduled to begin working for Disney in January, but my EAD was taking a very long time to arrive so we had to change my start date to May. During those five months, i would visit Austin (my now-husband) every two weeks. I finally moved to Orlando and worked for Disney. Our relationship was going very well! In june, marriage equality happened and we contemplated the idea of marriage. We got married on November 17, 2015.

And now for my question: I feel that we have quite a considerable amount of evidence to prove bona fide marriage. However, I am concerned about the fact that my parents are in the country illegally. Would the immigration officer see any issue with the fact that my parents have been in this country all along?

Your parents' status should have no effect on your case. If you are asked about it, answer truthfully. Once you become a citizen years down the road, you'll be able to file for their GCs.

I am slightly gob smacked you obtained non immigrant visas. I take it you did declare your illegal presence in the US and that your Parents were in the US?

I was never asked about my parents in the interviews but it was on my applications I submitted. As for my illegal presence, it was all before I was 18

With you overstaying your visa and attending school, would that be considered as intent? Like, did your family come to the states with the intent of staying here forever? I think that's one of the main questions immigration officers ask

Wouldn't he have denied the F1 Visa if he saw intent to stay?
