I recently appeared for a tourist visa interview and it was denied. I was going for promotion of my business and hold some business meetings. I have an outsourcing company here with 50 employees so i had to anyhow return to take charge of business after getting more clients.

My US based relatives suggested that applying tourist visa would be easier. I applied for tourist visa with my wife, but the visa was denied. Below was the conversation:

VO: Why do you want to go?

Ans: I want to visit places in US with my sister who lives there.

VO: Where will you stay?

Ans: At my sisters place.

VO: How long has she been there and what is she doing?

Ans: Shes is working with XXX and she is a permanent resident.

VO: What do you do?

Ans: I have outsourcing business.

VO: Whats turnover?

Ans: XXX lacs for last financial year. (the amount was big enough as I have 50 employees)

VO: (to my wife) What do you do?

Ans: I take guest lectures at a university

VO: Do you have any kids?

ANS: Yes 3.5 years and shes is not going along

VO: Sorry I cant approve your visa this time.

She dropped our passports with 214 B letter.

She refused to look at any documents that i had with me. Now what shall i do to reapply? How long shall i wait before reapplying? This time shall I apply straight for business visa? without my wife and daughter? I am going nuts.. please help…

You can't promote a business or have meetings on a tourist visa.

Never go by what's an 'easier' visa to obtain; rather, go by what's the right visa for your purpose. Your US based relatives ill-advised you.

B1/B2 IS the appropriate visa. It's for temporary visits, business or pleasure. Unless your circumstances have changed, you'll most likely be denied again. Lying about the purpose of your visit was unwise, too.

B1/B2 IS the appropriate visa. It's for temporary visits, business or pleasure. Unless your circumstances have changed, you'll most likely be denied again. Lying about the purpose of your visit was unwise, too.

That's not what the VO noted. My point is OP went for the 'easier' choice, inappropriately so.

No..

is the simple answer. The change must be material, or in other words, significant.

Applying soon, as well as the change in purpose could make you appear desperate.

So you basically lied about the purpose of the visit because you thought it would be easier to get the visa, and now want to change your story to the truth.

You think this suddenly makes you trustworthy?

The CO could see straight through your story and rightly denied you. Hopefully will deny you again if you reapply.

I was ill advised by my relatives. I first thought of business visa but they advised to seek tourist visa as I no meetings were already fixed. My clients are all from startup community. I had planned to participate in meetups and to network to get more clients. But since nothing was concrete, I was suggested for tourist visa and counted on them. But seems I will have to wait for at least 6 months to 1 year now.

Interesting thing is B1 visas have a higher approval rate than tourist visas though you end up getting both B1/B2 regardless of which route you take. You most likely should have applied for the B1 which was the real reason you wanted to come over to the US.

Yes i will certainly apply for B1 this time. but do you guys think 9 months to 1 year is a decent time gap to reapply? Also, as I m likely to face the same situation next time, is consulate going to buy my idea of attending meetups and casual business networking???

I have to return to India, that's mandatory... as I cant run on outsourcing business in USA and I already have 50+ employees... would the VO buy this as a strong reason?

In your words, will they '..buy my idea'.

If you are selling an idea, I'm sorry to tell you they won't be buying it for a penny! You have to have legitimate reasons and back it with concrete evidence on why you need the visa. Until then, don't go selling ideas at the embassy. They don't have time for that!
