Going back to Italy to visit, is it "safe"?

Hi all,

Not sure if this is the spot to post this, please advise me if it isn't!

I am a US citizen, my husband an Italian. We have a 12 month old daughter. He received his visa to come over here in August 2015, and his 2 year Green Card in February 2016. For the most part everything has been smooth sailing. He is currently doing seasonal work and we are due to renew our apartment lease soon. And understandably he misses Italy.

We are contemplating going back to Italy in the fall and returning to America between March-May ( I know I would need a visa) We don't have lots of money and seeing as our lease is up, now seems like the time to go before getting settled and finding permanent work. I would also like our daughter to see her Italian family.

I worry how we will finding housing when we get back, but more importantly, will my husband have no problem re entering the US when we return??

I've (we've) been struggling what to do and what is the right thing to do. Any advise/thoughts are appreciated!

You won't be in trouble since you don't need visa to return to US. You can your child can stay there however long your Italian visa allows you but you husband's GC is for permanent residency in the US not in Italy. But he can travel outside for no longer than 1 year else he will lose his GC.

Make sure that you plan for his ROC because if you won't have a lease here with his name on it and will be spending considerable time outside then you might run into trouble.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You will be risking your husband's GC. As a US Permanent Resident, he is required to maintain his main residence in the US. Trips longer than 6 months come under suspicion, he will need a reentry permit for anything past a year but under two years, but it is not a guarantee he will be allowed back in without showing US assets.

Thank you for the responses! Can you tell me what would be a reasonable amount of time to go back for? Tickets for the 3 of us are expensive, so we would like a good amount of time there. But it is more important we don't risk his GC status. Who would I call to get an answer? Thanks!
