The talk is the K-3 is dead, yet from time to time I see couples here at VJ go that route. I would look at some timelines to see if that is the direction you wish to choose.

10/7/15 Entered USA for three weeks to close escrow and pack house

12/5/15 Entered USA for 90 days to visit

NVC

12/23/15 NVC received package

1/5/2016 Called NVC

1/7/2016 Called NVC, assigned case # and IIN #

1/7/2016 Assigned choice of agent

1/7/2016 Paid AOS fees

No point in appealing a K1. It's been sent back to the US to die. Get married and prepare to file CR-1.

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

The problem is not on the USCIS side or the NVC side.

The COs questions centered heavily around my finances living and working situation in Pattaya.

Our case is not denied outright just sent back. I'm assuming it's a lack of bonfire relationship. However it's just a guess. This hit a road block at the interview and died right there. No requests for documents, no requests for second interview. No nothing from the embassy. That's a crappy black hole with zero feedback.

My Senators liaison stated she had seen where they show denied coming from the embassy. She stated this doesn't look that way but there is no information other than " returned to NVC".

when i case is sent back to NVC , it is because is denied even when they dont tell nothing.

but i am sure that they told something to your fiance at the interiew, after they questions, i am sure that they told something about the relationship and for that they sent case back, they found something that they didnt like and that they didnt belive the relationship.

all you will get from USCIS is a letter saying that the case is clossed, but no the reson, just a simple letter saying case clossed.

that letter can take severals months to arrive to the USC address.

Long story short, my original case was eventually reaffirmed by USCIS. In the time I thought it was a dead issue, I started another petition. 

 

Eventually both were in an approved state at USCIS. My Senators liaison was able to help get petition #2 pushed through back to the embassy and cancel petition #1. 

 

You have about a 60 to 90 day wait for the USCIS to cancel or reaffirm. My advice is to involve a congressman or senator or even a lawyer to see where the case stands once it arrives back in the US. 

 

Be patient. It takes time to come back across the globe.
