Hi , I was previously married to someone I brought over here to the states. Its been over 10 years ago, we are divorced. But my question is I'm in the process of bring my fiance over here , when the affidavit of support asked if I have previously submitted an affidavit of support for someone else, is it necessary to mention about my ex-wifes application? or is there a cut off time where its no longer needed to say so.

very crucial question. you should and you must declare all the beneficiaries you had petitioned in the past. i am certain there will be questions asked about this by USCIS. make sure you have the divorce decree handy and probably would not hurt to attach a copy during this new process.

Edit: I'm sorry I misread your post, thought it was referring to count your ex wife in your household size.

You should answer yes, since you submitted an affidavit of support for the ex wife.

Yep sure did when I filed my I-129f , I gave as much evidence needed that I'm free and clear. I imagine it was sometime in 2003/2004, I am not certain of the exact month a day when I filed my previous affidavit of support.

Ah , update I found in the I-864 and found this :

When Will These Obligations End?

A. Has become a US Citizen (Winner)
B. Has worked, or can receive credit for, 40 quarters of coverage under the Social Security Act
C. No Longer a Permanent Resident status and has departed the United States
D. Is subject to removal, but applies for and obtains, in removal proceedings, a new grant of adjustment of status

E. Dies

I think you should answer yes to the question about submitting another affidavit. When counting the household size, you can definitely leave the ex wife out, since she is a citizen now.

Another question crossed my mind ... my ex wife brought her parents and brother here to the US , but when she filled the papers I never saw them nor did I sign anything. Is it possible someone could user your name for affidavit of support with your knowledge, and is there way to know for sure ?

You'd have to sign it, so you'd know.

No, you would have had to fill out a form and sign it.

As to your question about the I-134 for the K-1 visa, you must answer yes that you previously filed a petition for someone and an affidavit of support. It doesn't matter how long ago it was. When you fill out the I-864 later for AOS, they will not need to be listed in your household count because they are now a USC.

ok , so I'm doing the I-134 , I got down to question 9 and 10 , so I did submit affidavit of support and have submitted for visa application back in 2003-2004 , but I don't remember the exact date. So, would it be acceptable to approximate dates ? or since she is citizen do I need to still list her ? I do want to answer as truthful with this form. Also 8, would it be wise to list my son even if he doesn't primary live with me, but I do pay child support.

It makes no difference if they are now a USC. The questions are asking if you previously filed an affidavit of support or petition. Yes, you have. So, you answer those. Yes, you can use year or year and month. You can also put Unknown if you truly cannot recall when you submitted the forms. If it makes you feel better, you can put '(now a US citizen)' next to their name.

All minor children are counted in your household size no matter where they live or who claims them on their taxes.
