I just want to double check that the path we chose will work.

We got an RFE for my I-864, stating I do not earn enough to sponsor, and we need to find a joint sponsor for my husband, who is here on a K-1 visa, filing for AOS. We have had a hell of a time finding a joint sponsor, so, long story short, we decided to keep it in our hands and not get a joint sponsor, but for me to get a part time job.

We have until about July 15th to return the RFE. I start my second job tomorrow. My plan is to get 1-2 paystubs from this new job, plus a letter from them stating my position, what I make, and that it is permanent, plus all updated information from my main, full time job (6 months of paystubs, and letter), sent out by July 1st.

Does this sound like it will satisfy the requirements, even though we're not sending in a joint sponsor? I'm just wanting to double and triple check. We don't want to chance a denial. It's been a very stressful time trying to figure it out.

They usually like to see at least 4-6 month of pay stubs but if you don't have it then you don't have it.
If you still can't find a sponsor then you don't have any other choice but to send it in and hope for the best.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

This will not guarantee approval.

Its a part time job that you JUST started; which means that you can as easily quit the part time job right after your approval, putting you under the poverty line and in the same boat that the USCIS sent you the RFE for.

This will not guarantee approval.

Its a part time job that you JUST started; which means that you can as easily quit the part time job right after your approval, putting you under the poverty line and in the same boat that the USCIS sent you the RFE for.

Always be careful, just because you meet the requirement doesn't mean they can't use their discretion and say no. We experienced this first hand with the K1 visa from when I was unemployed at the time, our cosponsor for the I-134 made 6k more than the requirement, we were asked to provide a SECOND cosponsor. Even with the original cosponsor working her job for 3 years, proving tax return, w2, and employer letter, it wasn't good enough. It's ALWAYS at the discretion of the person approving the paperwork.

There's a very good chance they won't take your part time job as a couple of weeks of having it isn't considered a stable job.


Plan to need a joint sponsor.

Depends on the IO, some send another RFE, some deny.

I will get a letter stating my income and that it's a permanent job. My husband has not been approved yet for his EAD.

Ok, gotcha. I was thinking you were the one applying and trying to add your income. If your part time job puts you over the requirement, then just list your total current annual income. List the full time as your main job and add a supplement to state you also have another job. Provide letters of employment and/or recent pay stubs from both jobs. Of course there is never a guarantee the USCIS will accept it, but since you are over the requirement, there is a fairly good chance they will, especially since you have had a steady full time job for 2 years. I think that part helps, even if the part time job is new.

We returned the RFE and so far he's been approved for travel and employment. No updates on the I-485.

I would like to know more detail as well....

what evidence did you end up sending?
