My family lived in the US from 1993-2005, in 2005 we were asked to leave the US on voluntary departure because our visa was invalid. We came back as requested by the judge and retrieved a bond on the arrival to Pakistan.


We have been back in Pakistan ever since. I'm not keen on going to visit the US but I am only asking for my mom, her sister's daughter is getting married and everyone of her siblings are visiting. We do not have any status in US, my father applied for sponsorship from his sister but even with the approval his sister did not move the case forward.


Can anyone offer assistance, I would visit a lawyer but I have no idea where to get assistance from.

Your mom applies for a US tourist visa to attend her niece's wedding. If the mom was part of the family that left in 2005, she should expect to be queried on those details. A previously denied immigrant petition will make it harder to get a visa. But your mom can spend the $160 and find out.

What visa were you in the US for during those 12 years?

I assume your mother was there as well.

Yes mom was there. We had a visit visa, my dads brilliant friends had the idea to just overstay as he applied for sponsorship from his sister during the time. I was only 7.

Partially why B2s are so hard to obtain from Pakistan.

There would have been a 10 year ban, assuming nothing else that would seem to be now up.

If she was issued a visa I would not expect any issue entering.

How old is your mom? She can apply, and she will have to disclose her deportation on her DS-160. Since it has already been more than 10 years she may alone get approved.

Shes 58, I will have to apply and see. I just feel it'll be hopeless because of deportation. Has anyone heard of cases where ppl come back to visit after deportation?

I dont mean to dis heart you but chances of getting tourist visa are poor. my father overstayed for few months in 1994 (at that time there was no bar for over stays). Left voluntarily. B2 was still valid upto 1996. Got another 5 year B1/B2 in 1998 but didnt visit US on it. after its expiry in 2003, my parents applied again.

my mom is a govt officer of high rank and visited other countries, visa officer approved her visa and kept passport. during interview with my father he found out from record about overstay, he straight away refused my father. Not only this but also returned my mothers passport( who never overstayed). My father never applied after that but my mother applied twice and both times she was refused on the same pretext despite her strong ties with Pakistan ie her job and family including small kids. we had no choice except to apply for their immigration.

Having said that, your mother may apply as luck might work for her. keep one thing in mind she should not lie when asked something and should not voluntarily disclose any thing if not asked. she should answer the questions honestly. if denied she will loose visa fee, thats it. Good luck.
