My cousin, a US citizen, wants to marry his girlfriend and bring her here from the Philipines. He is currently on a deferred sentence for felony drug possession. It was only a small amount for personal use. The felony will be expunged in two years, but will currently show up on any type of background check. This is his first and only arrest. Can he bring her here on a K1? We have heard yes and no and maybe, but would sincerely like to know if this is a deal breaker or not! Please only reply with facts, we've already been through all the maybes. Thank you in advance!

Doesn't matter.

The felony will be expunged in two years, but will currently show up on any type of background check.

It will ALWAYS show up on any background check USCIS conducts.

This is his first and only arrest. Can he bring her here on a K1? We have heard yes and no and maybe, but would sincerely like to know if this is a deal breaker or not! Please only reply with facts, we've already been through all the maybes. Thank you in advance!

Yes he can file, he will have to answer that question properly on the 129f form.
