Hi everyone!

I just want to clarify things.

When is really the expiration date of the k-1 petition? Is it a year from the date of filing or 4 months from the date of approval?

Please do enlighten me up.

Because our petition got approved lasy july142015 and valid until november132015. But we were not able to pay the visa fee before nov132015. And next week we are going to pay the visa fee. But before we pay the visa fee, could we still proceed with our petition?? Thank you!

The expiration date is printed on your NOA2, and is 4 months from approval. However, the consulate may, upon request, extend the validity in increments of four months, up to a year total.

You should email your consulate to see if they will do it in your case.

If it isn't difficult, it isn't worth it.

From the DOS K1 FAQs:

My Petition Expired – Can It Be Extended?

The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed.

REF: https://travel.state.gov/content/visas/en/immigrate/family/fiance-k-1.html

It is quite likely that you have to contact the embassy for further instructions.

~At that phase of the process.~

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

Get in touch with your embassy. We've had our NOA2 since last summer but haven't been able to proceed yet. We just had to email the consulate here in Germany and my fiancée had to send them a written statement with an original signature to extend the petition validity. No problems at all so far and they've even told us that even if the letter arrives after the first 4 months are over it's not a big deal at all.

Just make sure to get in contact with them and let them know why you want to wait.

I have the same issue...our petition was approved last nov 3,2016...but I don't have my passport yet because it has some errors and i need to have it corrected..our petition will expire on march 4, 2017...and concerned about how long it takes for my corrected BC to be released...but i also read here that it's common that consulate revalidate it without even asking or requesting for it..but im not so sure either but the thought of routine validation and extension by the consulate somehow ease my worries...
