Minus 85 days, help me understanding please.

Hello guys,

I'm super excited to say I'm less than 3 months away from completing 3 years as a permanent resident, hence I'm about to early filing the N-400.

The package is almost ready, and it will contain the following items:

- N-400 form, with all the questions being answered;

- 2 photos of myself;

- 2 money orders (595$ and 85$);

- front/back copy of my Green card.

It is my understanding all the above is what's necessary for a complete and successful filing, is anything missing?

Should I put all the content in an envelope?

My spouse is American and on July 3rd it will be 3 years from my Green card first release.

Since you're filing in three years based on marriage to a USC, that won't be enough. Take a look at the Document Checklist, Current Fees, Naturalization Eligibility Worksheet which has more details (especially the part under If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following 4 items on page 1).

I recommend not trying to exactly time the 90 days because there is no practical benefit to that. Send it like 80 days before the third anniversary because if it reaches a day early they send it back.

2006 - Entered US on F-1
2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship

You have to submit a lot more proof of the relationship (almost like removing conditions i-751) because you are applying with the 3 year rule. The only reason you can apply 3 years instead of 5 years is because of the marriage to a US Citizen, so they want to ensure that you meet those requirements, so you have to provide the proof.

I included:

Joint bank statements

Joint house deed

Tax transcripts

Medical cards showing part of same plan

Driver's licenses with same address on tem

and probably other stuff I can't recall right now.

CR1 / CR2 Visa:

(Day 1) 12/16/11: I-130 Application sent

(Day 283) 09/24/12: Interview at US Consulate – Approved!

(Day 287) 09/28/12: Visa Received & Immediately entered US using Visa

(Day 290) 10/01/12: Social Security Card sent automatically

Removal of Conditions CR1 / CR2
(Day 1) 07/28/14: Application sent.
(Day 135) 12/10/14: ROC Approved!
(Day 143) 12/18/14: 10 year GC received (IR1 / IR2)

Naturalization:
(Day 1) 06/30/15: Application sent.
(Day 210) 01/26/16: Interview and Oath Ceremony. DONE!

***Son and I became US Citizens 01/26/16***

(Day 1) 01/27/16: Applied for my U.S. Passport
(Day 14) 02/10/16: Passport Book & Cert of Naturalization received

(Day 1) 03/16/16: Applied for U.S. Passport for son

(Day 22) 04/07/16: Passport book and original docs received...(Card rec'd 04/16/16)

N-600 for child age 9
(Day 1) 01/27/16: Application sent

(Day 12) 02/08/16: NOA received

(Day 23) 02/19/16: Case received at local office

(Day 88) 04/23/16: In line for oath scheduling *Called USCIS to inquire about why there is an oath required for a child under 14. They sent a service request to the field office.

(Day 95) 04/30/16: Received letter from field office to say no oath necessary and that they would mail the certificate.
(Day 106) 05/11/16: Cert of Citizenship received by registered mail (they never sent tracking. case status was never updated either)

Marco - the list you noted appears to be complete. I submitted exactly the same what you have on the list when I applied based on 3-year rule. Lot of folks on this forum submit ROC type of evidence when applying based on 3-year rule which is not required. At least, I have not had any issues of application being incomplete or any RFEs.

But do remember to carry evidence of your legitimate marriage when appearing for the Citizenship Interview.

There has been an update on the N400 form, but they will accept the old form until August of this year.

The most important part here is that they've updated the instructions to include what you should bring to the interview: https://www.uscis.gov/sites/default/files/files/form/n-400instr.pdf

For what it's worth, I submitted my application with only the three IRS transcripts of the past three years as my evidence, on top of the required submission materials (photos etc.)

07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

I am a United States citizen!
