Hello!

First post here...

My fiancee (petitioner, based in California) and I are getting ready to submit our I-129F package with the necessary forms and photos. I've mailed across my signed G-325A, letter of intent, copy of birth certificate and passport. I also included 2 x passport style photos. I've since been informed that UK and USA passport photos differ in size/dimensions...

Can anyone advise if I should get some new photos taken and mail these across, or do you think our package will be ok with the UK style photos?

Thanks in advance for any help - trying to not get stressed out by this whole process!

Alex

Your birth certificate isn't needed until the interview. Your passport is only needed if it's because you have stamps in there as proof.

And yes you need new passport pictures so you won't get an RFE. Remember to write your names on the back of the pictures too.

Thanks for such a quick reply!

When I got my photos taken in the UK I was provided with a digital copy, and I've read about some sites that let you upload a passport photo and they print it and send to you (I could do this for my fiancee in California). Hopefully that could save some time...

I think it is Walgreen she can go to and get it printed out. (Probably also a lot of other stores)

The Dept of State provides a free passport photo tool on this page https://travel.state.gov/content/passports/en/passports/photos/photos.html

If you can take a digital photo against a proper background, you can do your own. Don't try to take a head shot. Take all of the torso as well and the tool will zoom and crop fo just your head. Then you have a digital photo to email to him. If he doesn't have a printer and photo paper, he can take it to most any photo department at places like drug stores or Walmart and get a print made. It will be a white 4x6 photo with the proper passport photo in the middle to cut out.

Thank you! I'll let him know to do this. So much information to process for this whole thing, really appreciate your help trying to make sense of it all and make sure I've got everything in place.

Yes you will get a RFE. I got an RFE because the passport photo was one inch off. They didn't specify in the RFE letter what EXACTLY they wanted or what was wrong with the original application. Just that they needed passport photos. So I sent it in again and they denied my WHOLE K1-visa because the passport picture dimensions were off. So unfortunately, expect an RFE. While you wait for the RFE letter, just get the passport pictures with the correct dimensions ready so you can send it in immediately after you receive the RFE.

As said yes you'll get an RFE and like he/she also said use your time to correct it so you have it ready and can respond right away :)

Oh #######!!!!! I sent ours with my UK sized passport photos for myself. Does this mean I'll get a RFE? I've been waiting 77 days now with still no word so presumed I'd have got an RFE already? I also filed mine through rapid visa whom accepted it all... Bit annoyed that they'd send it knowing it was the wrong size !!

I was wondering about timescales as well - I understand it varies for everyone, but does anyone know an estimate of how long it can take for the RFE to come through?

No one can tell since it is very different from case to case but try and look at Igor's list to get an idea.

If you fill in your timeline, you will get an estimate for when you should've got NOA2. A notice of RFE should come around the same time :-)

If it isn't difficult, it isn't worth it.
