Hello all!

I am about ready to send off my AOS & IV package for my husband to the NVC and I was hoping all you helpful people on VisaJourney could help me make sure I have everything I need :)

So for the AOS section of the package I've included:

1) The i-864 form

2) a signed affidavit stating that I didn't have to file taxes the last three tax years (I'm a student and don't work)

3) The i-864a form (My dad is a household member that will be sponsoring my husband since I don't work)

4) My dad's IRS tax transcript from 2014

5) My dad's form W2 from 2014

6) My dad's form 1099 from 2014

7) My dad's employment letter

8) My birth certificate accompanied with its English translation (to prove the relationship between me and my father)

For the IV section of the package I've included:

1) My husband's birth certificate with an English translation

2) Our marriage certificate with it's English translation

3) A photocopy of the biographic page of my husband's passport

4) Two passport sized photographs of my husband

5) his police certificate

I'm only sending photocopies of the documents not originals.

I'm hoping this will be enough to send.

Also, I had a question about the Document Cover Sheet I got with my welcome letter. What do they mean by "Other Documents" on the sheet? Does that just refer to any other documents I'm including that don't fit into the other categories listed? Since I'm including my dad's 1099 form should I check off 'enclosed' for "Other Documents" since the 1099 form is not included in the list on the cover sheet?

AOS package:

  1. Good
  2. Doesn't need to be a signed affidavit, a simple statement explaining why you were not required to file is sufficient.
  3. Just semantics here, your dad is not sponsoring, the purpose of submitting an I-864A is for a sponsor to combine income with a household member to meet the qualifying threshold (i.e. you are combining income with your dad to qualify). Even though you have $0 income, you are still regarded as the sponsor.

You are correct to only send photocopies of documents. Checklists are issued for missing documents or incomplete forms, if you send what is required and fill out the forms correctly, you shouldn't have receive a checklist.

Thank you for the quick response! My parents filed taxes jointly so I figured that simply the tax transcript wouldn't be sufficient and that I should include the W2 and 1099 as well. Do you think I should exclude them?

The part of your post I placed in bold and red was something I overlooked in my response. Since only your dad is signing a form, then you were correct to include the W2 and 1099 since you are only combining income with your dad.

The part of your post I placed in bold and red was something I overlooked in my response. Since only your dad is signing a form, then you were correct to include the W2 and 1099 since you are only combining income with your dad.

Alright, thanks! So I assume I'd check off 'Other Documents' on the document cover sheet since I am including the 1099 form? Since it wasn't listed on the sheet.

You could instead make your own "checklist" of sorts with a cover letter that lists in order each of the things in their and then instead of having a generic "other" you'll have listed literally what you put in the stack.

Thanks for the info! Also, would you know whether my dad needs to submit evidence of his U.S. citizenship? I wasn't able to find any information on that.

Yes

Oh is that really the case? I know the sponsor has to include evidence of citizenship but I didn't realize the household member had to also. I also forgot to mention that I've already included a copy of my naturalization certificate in the packet.

Signers of an I-864 or I-864A are required to be a US Citizen or LPR domiciled in the US. A petitioner is automatically deemed eligible to sign an I-864 on the basis an approved I-130; therefore, a primary sponsor would never have to include evidence of citizenship with their I-864 (this would've already been done at the I-130 filing phase). However, since a joint sponsor or household member would not have an approved I-130 on-file, their eligibility needs to be verified.

Okay that makes sense! That's what I assumed but I couldn't find the information anywhere. Thank you so much for your help. I think I'll be ready to send off this packet tomorrow!

Just saw this post now and you may have sent your documents already. Looking at the list of documents you are including in your packages, I dont see the AOS and IV bar coded cover sheets. And more importantly, I dont see any proof of Bona Fide marriage in the IV package.
