Planning to withdraw AOS application

Hi,I'm new here.I'm glad that i have found this site.For those who have an idea or have the same delimma as me,please give me your advice.We filed my AOS 1st week of January 2016 through a lawyer,had my biometric last Feb.12,2016.On Feb.23 got an RFE,it seems like our lawyer did not submit our supporting docs as it was stated on the RFE.My husband used asset to support me and we submitted everythng that is needed ,that is latest appraisal of his house,title and ownership etc.and a cover letter stating that he will use asset,but we still got RFE and this means delay on my application.Anyways,for the meantime we already sold the house and we decided to leave US and settle in Asia so our plan now is to withdraw my application because we are not going to reside here anyway.He lost his job 3 years ago.And he felt that there is nothing for him here now.I came here using my tourist visa and I'm out of status now since Oct.2015 .My question is if I withdraw my AOS and go back to my country with my husband,can I apply for a tourist visa again?or will I be banned for 10 years. I am not so after now with getting a GC,my only desire is to have a tourist visa to come here,just to visit once in a while.My lawyer is not very helpful,when i told her about our plan to withdraw she just said okay we will withdraw it! Without giving me advice and giving me pros and cons ! I hope somebody will give me an advice,I will value and appreciate all your input.

Yes, overstay is only forgiven when adjusting status through marriage to a USC. Since you won't be doing this, your ban will be for 3 years. Its 3 years if its more than 180 days but less than 1 year.

Did your I-94 expire in Oct 2015? What is the exact date that said you needed to leave the US by? If you leave before the 180 days then you won't be subject to the ban.

So that means your 180 days will be up on April 5, 2016. If you leave after this date, then yes, you will receive the 3 year ban.

Leaving after October 8, 2016, you'll receive the 10-year ban.

Regardless of the bans, as stated above, you will have a harder time receiving a tourist visa most likely because of your overstay.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Regardless once you and your husband leave the country that Green Card will be null and void...That green card is for permanent residents. If you and your husband decide to move. Yes, the Tourist Visa will be a bit more difficult but not impossible especially if you prove that you moved away permanently. Just have to make a good case that you don't wish to move back to the U.S. just want to visit and go back with or to your husband.
